Chilean court orders Catholic Church to compensate victims

An appeals court in Chile ruled Wednesday that the Roman Catholic Church must pay compensation to three victims of the Rev. Fernando Karadima, the country’s most notorious pedophile priest.

The court in the Chilean capital said that the church must pay about $150,000 each to Juan Carlos Cruz, Jose Andres Murillo and James Hamilton for “moral damage.” It also overturned a lower-court ruling that found no proof of a church cover-up.

The ruling could prompt hundreds of other people who have reported clerical sexual abuses or cover-ups by the Chilean Catholic Church to seek compensation.

“This helps all of us who have lived through this horror, and that’s why we’re happy,” Cruz said on Twitter.

The office of the Santiago Archbishopric said in a statement that it was in “consent” with the court’s decision, and that it “hoped that the ruling will contribute to the process of reparation of the pain suffered by Fernando Karadima’s victims.”

The ruling said that church officials had harmed victims by dismissing their complaints of abuse rather than investigating them.

The Vatican in 2011 sentenced Karadima, a powerful preacher close to Chile’s elite, to a lifetime of penance and prayer for his sex crimes, and Pope Francis defrocked him last year.

During a 2018 trip to Chile, Francis initially dismissed allegations that a bishop had covered up Karadima’s crimes, but the pope later acknowledged “grave errors in judgment” and asked all active Chilean bishops to offer their resignations.

Chilean abuse survivors had long accused Cardinal Ricardo Ezzati and his predecessor in the Chilean capital, Cardinal Javier Errazuriz, of protecting predator priests and discrediting victims.

The ruling on Wednesday named them both. The pope removed Errazuriz last year from his informal Cabinet and he replaced Ezzati on Saturday.

Part of the evidence that led to the ruling included a 2009 letter from Errazuriz to the apostolic nunciature that showed that he was aware of the abuse.

The scandal first erupted in 2009 when victims publicly accused Karadima of molesting them for years. Errazuriz initially shelved an investigation.

Finally, justice for these three long suffering victims, who have shown great courage and perseverance.

Even Pope Francis regarded them as liars, so anxious was he to support his bishop friend who covered up for their abuser.

There are only two things that the RCs don’t like:

1. Widespread exposure of their dark, dark deeds.

2. Having their wealth taken from them by the courts.

But both are set to continue – continuing international exposure and wealth being removed from them by national and international courts.

Add to this dwindling numbers in the pews.

This week the Irish Times carried statistics stating that church attendance has dropped in Ireland from 90% in the 1970s to 30% today.

In another 10 years that will be well below 10%.

I predict that in time to come Italy will overturn the 1929 Concordat and the “holy see” will be a neighbourhood of the City of Rome.

The unpopularity isn’t so much with Pope Francis as it is with the institutional Church, in particular, the papacy. And the trail of disilusionment to this started long before Francis’ pontificate, very long before it. But if you leap to the time of the Polish pope, you’ll find that it widened.
The sexual scandals to which we all have become innured began to show, in earnest, during the Pole’s papacy. Along with all of the cover-ups, in which the Pole played a key part.
Poor Francis inherited primarily the Pole’s mess, and that left by the German.😆

The light of God’s justice is breaking through into the dark areas of the Church. This is redeeming for all victim/survivors. This light will also expose the corruption, deceit and cover up of horrible wrongs, evil and abuses. It will also expose all abusers and those complicit in enabling the abuse. I hope too this light of God’s justice will inspire the many good people in our churches, laity, clerics and religious. Only the light of God’s justice and mercy will lead us forward if we respond appropriately. It is a very challenging time for all of us in the Church to assimilate this moment of God’s grace prompting us to be truly repentant, accountable and caring – a caring that places the hurt, wounded and broken at the heart of ministry. Christ is our icon to imitate, He and He alone.

You disparage 8.59’s contribution, but it is the thoughts of someone who sees the hand of God at work in ‘uncovering that which has been covered,’ and who is happy that God is uncovering the wrongdoing. I agree with 8.59 that God is at work and rejoice that evil is at last being exposed.
I hope you are praying, 8.59, for further cleansing of the Church and for the end of all compromises of the Truth. Our Lady told us that Cardinal would oppose Cardinal and that the Church would be full of those who accept compromises.
Our Lord may have cleared the temple like a man, but Our Lady is now clearing house like a woman – and she won’t miss any corners.

8.59: Let me assure you Ballycastle Brian, I live in a very real world. I live with, for and amongst people every day. I have a very clear conscience about my integrity in what I try to do “faithfully” in my ministry. Yes, I strive to live authentically and to give greater witness to Christ. I am very aware of the deeply flawed and sinful institution I belong to. I, on my part, sinful and flawed, ensure I act very responsibly, caringly, truthfully, justly and compassionately -(though these words seem irrelevant to you) – but these are my words that encapsulate the essence of Christ and his gospel. I abhor all abuse. I have spoken publicly about it and commit myself to all that is best and good in people, in the parish where I work and try to make our community more welcoming and Christian. Despite the crises I do not look for an excuse to discontinue in ministry but am always trying to renew myself and hopefully others in the process. And incidentally, I depend, as always, on the grace of God to help me in all that faces me each day. Thus my need for frequent prayer. And, while you are cynical in consigning me to a past century, I am, thankfully, able to recognise the presence of God at work now in our Church….all will be revealed and all will be made whole again. I live in hope and promise, rooted in God’s fidelity of love. It works….

What a pious sermon you preach!
The light you speak can only expose, but it can lead no one anywhere unless people are willing to follow it.
Roman Catholic priests are not willing to follow the light, because they nearly all have remained silent instead of courageously and publicly witnessing to the corruption, complicity and duplicity in the institutional Church…of which they are part! Not one priest…not one…in Down on Connor witnessed in this way when his bishop, Noel Treanor, lavished a huge sum of diocesan money on his home. These men should be living no better than the poorest of their parishoners; instead they live like, well, princes. Why would any poor person in the diocese listen to a hypocrite, like Noel Treanor, when he preaches about the poor? I’ll bet Treanor, during the long cold winter months, did not have to worry about heating his home for as long as he was comfortable with; the poor in his diocese cannot do so. There is no ‘heat or eat’ with Treanor, or with ANY of his priests.
The loyalty of these Christ-betrayers is not to God, but to the institution. And they all have proved this fundamental fact over and over. Why are so many blind to this reality? It is both the heart AND the cause of moral decay in the Church.

In this case, is the Church responsible in some way for the actions of its priests and bishops, and should they be required to compensate victims ? In many countries the fiction that the Church has no responsibility for priests and bishops because they are seen as independent contractors, has been overturned in the courts, and the Church is seen as being in part responsible in some degree for the actions of priests – vicarious responsibility it’s called. + Pat raises some important points about when and how the Church will be called to account for the terrible things that have happened at the hands of its priests, and the consequent coverup by a hierarchical, clerical, protectionist Church.

Young McGeehan needs to lower his head a bit, and stay out of the limelight. He is in a very vulnerable position and no doubt his bishop has had something to say to him already. I think it’s time for him to pipe down and lay low if he wants to proceed to ordination in a reasonable timescale. Reading some of the most vitriolic comments on this blog, and thinking about the personalities involved, caused me to seek comments I read a log time ago about the serial murderer, Dr Fred Shipman. Having found the book I quote it concerning views on Shipman’s personality and colleague’s impressions of him.
I leave it to readers to consider whether any of the blog’s regular contributors fits the descriptios in the quotes.

“While he could be arrogant and supercilious in his manner, I was never aware of him falling down diagnostically. I think he was a sound doctor but his main failing was that he always had to prove he knew more and was better than anyone else. He was always trying to prove himself, and I imagine he thought we were all impressed by his knowledge. He was certainly very smug about it. But replying to your comment, the plain fact ( though you will probably deny and argue otherwise) is that you are wrong!
While the title of the book refers to “Dr Harold Shipman”, his full given name was Harold Frederick Shipman.
I quote from p25: “The boy was always known as Fred, to avoid confusion in the immediate family”. ( His father was known as Harold) Throughout the book he is always referred to as Fred by the authors of their own volition, and in referring/quoting the many colleagues and patients involved. For example, on p97, when confronted by fellow GPs about his pethidine addiction, colleague GP John Dacre addressed the surgery practice meeting and Fred, saying, “What’s all this then young Fred”?
Given your past record Magna no doubt you will contradict and argue otherwise. Feel free.
You just refuse to listen, and will never learn.
Sad. But then it’s your choice, and burden.
I will make no further comment on the matter bearing in mind past advice comments concerning the feeding of trolls.

By the way, according to news bulletins at the time, Shipman was always referred to as ‘Dr Harold…, both on television and in the Press. He may have been known as ‘Fred’ to his immediate family and to some of his medical colleagues, but professionally, he was known as ‘Dr Harold…’. That’s a fact, not a matter of arbitrary argument by me.😆
