CARDINAL GEORGE PELL TO APPEAL TO HIGH COURY OVER CHILD SEXUAL ABUSE CONVICTION.

Lawyers for Cardinal George Pell have lodged a special leave application with the high court to try to appeal his historical sex abuse convictions, which will be his final avenue to have his conviction overturned.

The high court on Tuesday confirmed it had received the application through its Melbourne registry.

The lodging of the appeal does not mean the high court will agree to hear the case. First, the matter will be considered by a panel of two to three judges, and will either be dismissed or approved. The parties may be called to a brief hearing for further consideration. A decision about whether special leave to appeal will be granted is usually made on the same day as the hearing.

At least five and sometimes all seven justices of the high court will hear the appeal if it is granted. The appeals process can take several months, and is unlikely to be considered before 2020. In the meantime, Pell remains in Melbourne assessment prison, receiving letters and visits from his supporters. Pell has maintained his innocence throughout the process.

The 78-year-old was sentenced to a six-year prison sentence for sexually abusing two 13-year-old former choirboys at St Patrick’s cathedral when he was the archbishop of Melbourne in 1996. He will be eligible for parole after serving a term of three years and eight months.

In August, the Victorian court of appeal – the highest court in the state – dismissed Pell’s appeal. He had 28 days to appeal to the high court, with lawyers filing his application at the 11th hour on Tuesday. However, filing at the last minute is not unusual.

The jury had not been unreasonable in convicting Pell on one count of sexual penetration of a child under the age of 16 and four counts of an indecent act against a child under the age of 16, the Victorian court of appeal chief justice, Anne Ferguson, and appeal court president justice, Chris Maxwell, previously found.

George Pell has every legal right to take his appeal to the very end of the legal chain.

For now he has been found guilty and is in prison.

If he is guilty, and a court has said he is, it is very cynical of him to put the victims through a lengthy battle in which they will relive their sufferings.

He seems to be in a “nice” prison where he is visited by many supporters.

That is fortunate for him.

He has had a long privileged life of power, influence, control and no shortage of funds.

Do we even know who is paying his massive and mounting legal fees?

Is Sydney archdiicese paying them out of church funds?

If so, is that ok?

It will be good when this long saga is over.

Even if his appeal is accepted the court may order a retrial.

If the institutional Church is financially assisting Pell (and I believe it is), some of that money may have come from families whose children were sexually violated by cowardly priest-leeches like Pell.

I’m disturbed at the way you constantly assume Cardinal Pell’s guilt. Several distinguished writers have written articles about this & those articles are there for all to read. Cardinal Pell himself said he doesn’t fear the courts here on Earth. The Last Judgement is what he & everyone of us should fear. I believe Cardinal Pell has every right to appeal this case against him. He is a citizen of the land and therefore is entitled to pursue his belief in making an appeal. Till then defy I give judgments should be reserved..Pat, you are not “god” deciding the fate of others, however despicable their crimes. I’ve just heard that all the good priests in Australia (and, indeed, around the rest of the world) have taken to the streets to protest the institutional Roman Catholic Church’s continued financial support for Cardinal George Pell, the convicted paedophile. The scenes are heady. I never knew we had so many good, courageous priests. Fr Gerard McGinnity was right after all: these lions truly deserve the name ‘Christmen’.

The telly news reports are full of it. (Mind you, so is the very idea of good , courageous priests. 😕)

MC says nasty things in nasty ways sometimes but at other times makes very thought provoking comments.

I totally agree with the suggestion of restricting multiple comments, and my preference would be for a maximum of five. Repetitive immediate “shooting from the hip” excessive comments of a similar nature tend to show little thoughtful reflection on others viewpoints, and often betray a rigidity of thought impervious to any meaningful dialogue or significant effort to appreciate others perspectives. I prefer the blog to promote debate and dialogue rather than a tool for lambasting others opinions.
Yesterday I posted a comment to Magna urging him to reflect on his approach. I hope he has read it, and suggest that some others who repetitiously comment likewise might consider it too.

Personally I would come at that from the perspective that because we are fallible we have to be open to others reflections. But are you sure this blog is the place for that openness? You would still get opposing views posted as comments but I feel there’s a danger that the view you give above doesn’t come across.
I also appreciate that while friends may not be the best mirrors because of being biased towards you is it such a good idea to take much account of actual enemies? They simply want to discredit you.
