SAN FRANCISCO – A California transgender man can go ahead with a discrimination lawsuit against a Catholic hospital that canceled his hysterectomy, an appeals court ruled Tuesday.

The decision by the 1st District Court of Appeal in San Francisco overturns a lower court ruling dismissing the discrimination lawsuit, The Sacramento Bee reported Wednesday.

Evan Minton sued Mercy San Juan Medical Center in 2017 for canceling his scheduled hysterectomy after he mentioned to a nurse two days before surgery that he’s transgender.

Hospital operator Dignity Health quickly helped transfer the surgery to a non-Catholic facility. Presiding Judge Stuart Pollak wrote that didn’t negate Minton’s complaint because Dignity offered the alternative only after pressure from his advocates.

California civil rights law says businesses must offer full and equal access to residents.

Dignity Health, which is among the largest health systems in the country, said in a statement Wednesday that it welcomes everyone but that its Catholic hospitals “do not perform sterilizing procedures” unless there is a serious threat to the patient’s life or health.

In an earlier statement to the newspaper, the largest hospital provider in California said its Catholic facilities “do not provide elective sterilizations.”

Dr. Lindsey Dawson, Minton’s surgeon, has said she routinely performs hysterectomies at Mercy San Juan.

Minton was diagnosed with gender dysphoria, a medical condition where a person experiences deep discomfort with the gender assigned them at birth, according to the American Psychiatric Association.

Here we have another sad case of the RC institution discriminating against a young vulnerable man who has already suffered much.

He is not seeking a hysterectomy for moral/immoral reasons.

The hysterectomy is recommended by medical professionals for medical reasons.

It is part of his “healing” – and it is 100 % legal.

The RCC and its adherents are entitled to believe what they want and impose medieval medical and social mores on their volunteers.

But such teachings have no place in modern medicine and they should never use tax payers money to impose those teachings and practices on society.

Gradually former Catholic societies are freeing themselves from their Roman masters.

I’m glad I’m living to see Rome chalenged so universally.

And I hope Evan Minton takes a fortune off them.

You have created a false theology with a complete disregard for God. You’d say yes to any medical procedure you seem inconsistent with your makey up ethics. Even Minton should have been truthful in the first place and I’m sure his/her doctor would have advised that the hospital had a Catholic ethos…wonder was he/she simply wanting to sue!!! Hope he/she gets nothing. The a Catholic religious Sisters in the USA can be proud of the healthcare services they provide. The best. I’ve been there and witnessed at first hand the excellence, not just of the Catholic hospitals but of other denominations too. We in Ireland coukd learn much from their expertise and superb quality of services, similar to the sterling service given by religious orders to Irish hospitals. So, Pat, have a go all you like. In this area of gender choice and experimentation hospitals have moral and ethical responsibilities which are clear enshrined in their ethos statements. Change in everything seems an unfolding reality, change in our thinking, our sering, our understanding thriugh science, psychology, theology and philosophy. It is inevitable that one day scientists, medically and otherwise would see the human psyche in a million different ways and possibilities. I fear that we are playing god too much sometimes with the potential possibilities of what we can “recreate” out of what is already given and make something completely different that the original reality. The sexual/gender experimentation with the human person deserves absolute regorous scrutiny. I have watched prigrammes on gender challenges which featured children aged 3, 4, 5 , and 6 year olds and young teenagers atrending classes with gender transitiining specialists. It raised many moral andvethical questions which weren’t addressed. I was very disturbed watching this programme about such young children almost being brainwashed (by the parent’s chouce) to be something g other than who or what they were born as! We need to be very watchful and vigilant around experimenting with human nature. Yes, I concur, it’s great sometimes not knowing what’s around the next corner…once it’s not Magna!!!

Dear Bishop Pat, Gender Dysphoria is a mental condition, not a physical one. The disposition of chromosomes is not an outdated standard; it is a physical fact. Very occasionally people are born with the genitals of both sexes. That is a physical condition. It is not Gender Dysphoria. Dr. Michelle Cretella, President of the American College of Pediatricians, in an interview she gave to TFP Student Action in 2017, said that it is not true that people can be born into the wrong body. She says studies on twins, who actually have the same body, have shown this. She points out that there is a mental disorder in which people believe themselves to be amputees, and demand that their limbs be cut off. We do not allow this to happen. She says that we should not allow impressionable children to be convinced that mutilating their bodies will change their sex. In her experience, counselling and encouragement very often help such children to come to terms with their body. What adults do is up to themselves, but surely the presence among of masculine women and feminine men only adds to the joy of living among human beings. They don’t need to mutilate themselves.

Gender dysphoria is a condition where a person experiences discomfort or distress because there’s a mismatch between their biological sex and gender identity. It’s sometimes known as gender incongruence.

Biological sex is assigned at birth, depending on the appearance of the genitals. Gender identity is the gender that a person “identifies” with or feels themselves to be.

While biological sex and gender identity are the same for most people, this isn’t the case for everyone. For example, some people may have the anatomy of a man, but identify themselves as a woman, while others may not feel they’re definitively either male or female.

They may also have a strong desire to change or get rid of physical signs of their biological sex, such as facial hair or breasts.

Getting help
See your GP if you think you or your child may have gender dysphoria.

If necessary, they can refer you to a specialist Gender Identity Clinic (GIC). Staff at these clinics can carry out a personalised assessment and provide any support you need.

Assessment
A diagnosis of gender dysphoria can usually be made after an in-depth assessment carried out by two or more specialists.

This may require several sessions, carried out a few months apart, and may involve discussions with people you are close to, such as members of your family or your partner.

The assessment will determine whether you have gender dysphoria and what your needs are, which could include:

whether there’s a clear mismatch between your biological sex and gender identity
whether you have a strong desire to change your physical characteristics as a result of any mismatch
how you’re coping with any difficulties of a possible mismatch
how your feelings and behaviours have developed over time
what support you have, such as friends and family
The assessment may also involve a more general assessment of your physical and psychological health.

Treatment for gender dysphoria
If the results of an assessment suggest that you or your child have gender dysphoria, staff at the GIC will work with you to come up with an individual treatment plan. This will include any psychological support you may need.

Treatment for gender dysphoria aims to help reduce or remove the distressing feelings of a mismatch between biological sex and gender identity.

This can mean different things for different people. For some people, it can mean dressing and living as their preferred gender.

For others, it can mean taking hormones or also having surgery to change their physical appearance.

Many trans people have treatment to change their body permanently, so they’re more consistent with their gender identity, and the vast majority are satisfied with the eventual results.

What causes gender dysphoria?
Gender development is complex and there are many possible variations that cause a mismatch between a person’s biological sex and their gender identity, making the exact cause of gender dysphoria unclear.

Occasionally, the hormones that trigger the development of biological sex may not work properly on the brain, reproductive organs and genitals, causing differences between them. This may be caused by:

additional hormones in the mother’s system – possibly as a result of taking medication
the foetus’ insensitivity to the hormones, known as androgen insensitivity syndrome (AIS) – when this happens, gender dysphoria may be caused by hormones not working properly in the womb
Gender dysphoria may also be the result of other rare conditions, such as:

congenital adrenal hyperplasia (CAH) – where a high level of male hormones are produced in a female foetus. This causes the genitals to become more male in appearance and, in some cases, the baby may be thought to be biologically male when she is born.
intersex conditions – which cause babies to be born with the genitalia of both sexes (or ambiguous genitalia). Parents are recommended to wait until the child can choose their own gender identity before any surgery is carried out.

How common is gender dysphoria?
It’s not known exactly how many people experience gender dysphoria, because many people with the condition never seek help.

A survey of 10,000 people undertaken in 2012 by the Equality and Human Rights Commission found that 1% of the population surveyed was gender variant, to some extent.

While gender dysphoria appears to be rare, the number of people being diagnosed with the condition is increasing, due to growing public awareness.

However, many people with gender dysphoria still face prejudice and misunderstanding.

Gender terminology
Gender dysphoria is a complex condition that can be difficult to understand. Therefore, it helps to distinguish between the meanings of different gender-related terms:

gender dysphoria – discomfort or distress caused by a mismatch between a person’s gender identity and their biological sex assigned at birth
transsexualism – the desire to live and be accepted as a member of the opposite sex, usually accompanied by the wish to have treatment to make their physical appearance more consistent with their gender identity

To date I have accompanied three people through gender change.
All of them suffered greatly as children, teenagers and young adults.
They were absolutely miserable within. The doctors made them progress very slowly and carefully.
When they completed their journies they were all happier and more integrated people. Their transition was a total success.
