GOD SAVE THE QUEEN 😊

I am not a fan of the Windsor royal hangers on and I think the British monarchy needs to be drastically scaled back.

But I am an admirer of Queen Elizabeth II and I was impressed with her address to the nation on Sunday evening.

I admire Elizabeth because of her devotion of her duties over a 70+ year period.

Anyone, of any race, of any age, who devotes themselves to their duties and responsibilities, is a good person and deserves both respect and the acknowledgement of their service.

As I say, I do think that the Windsor hanger’s on need to go. There is a very good reason to keep the heir and heir number two on full time retainers.

But, in the 21st century, there is absolutely no reason to keep people like Anne, Andrew, Harry etc on the payroll – not to mention the whole gang of dukes and lords.

Also, there is no need for the royal family to have a whole load of palaces all over the place – costing the public multi millions

Buckingham Palace or Windsor is enough.

Let the others be turned into hospitals, schools or sold off to hotel chains.

Doctors and nurses, especially, at this time, are true heroes.

The standard of legal proof in criminal cases is high: ‘beyond all reasonable doubt.’ Years after the alleged crime, without reliable evidence, such as forensics, it can boil down to alleged victim’s word versus the defendant’s.
In a civil case “on the balance of probabilities ” is sufficient for a finding of proof. Pell’s trial was on criminal charges.
Had it been available, the Scottish legal option of “Not proven ” might have been relevant in the initial court trial.

You need to remember that Pell was not declared not guilty: the High Court’s ruling makes it clear that the evidence against Pell was insufficient for conviction beyond reasonable doubt. This is a JUDICIAL ruling: it is not necessarily an expression of truth in this matter. Miscarriages of justice work both ways: people can be wrongfully convicted, and people can be wrongfully acquitted.

It is my firm belief that Pell was wrongfully acquitted. It is my belief also that a dangerous paedophile has been released from prison.

In the matter of the Pell case, everybody is a loser, everybody is hurt. How sad. We have to accept the decision of the High Court of Australia that he is not guilty, no matter what we might think. That’s the law. This will be very hurtful to so many who have been hurt and damaged by abuse, not necessarily that claimed against Pell, but by anybody connected with the Church. Let us try and be kind to all involved in this tragedy – yes, even to Pell himself. It is only by being kind and loving to each other, even to the sinner, that we can move forward.

Many people will be hurting today, not because of the acquittal of Cardinal Pell, who deserves his justice, but because the trauma of abuse is always resurrected when we speak of abuse, particularly when a high profile person is accused of abuse. I hooe that all survivors will find support, help and counselling at this time. In the pandemic we are going through it is easy to forget all who are hurt by abuse, sexual, domestic and other ways. Services for help are not now readily available. Justice is guven to Cardinal Pell and I’m certain that he is not gloating in any way but he has his moment of aquittal: justice has seen to be done. Have any of you given Pell’s accuser one moment’s consideration? This man alleges that he was orally raped by Pell when he was just 13 years old. Now, with the high court’s ruling, it must, from his point of view, seem that he is being abused again. On top of everything else, he will now be called a liar. This is what abuse victims tend to endure: being called liars for daring to claim that adults sexually assaulted then. And when the perpetrator is a Roman Catholic cleric, that denunciation is all the more severe.

Pell was acquitted ONLY in legal terms. If he commited those serious offences (and I believe that he did), then the truth remains the truth, no matter the ruling of the high court.

I hope Pell’s accuser draws some satisfaction from the fact that very many people globally, including me, believe him, not Pell.

Pell’s reputation is in tatters now; it can never be mended.

His victory in the high court is entirely pyrrhic. I hope his accuser draws satisfaction from this, too.

These rules on this vary between jurisdictions. And can also change over time.
But after this morning’s quashing of his conviction — and since he has excellent lawyers — the Cardinal might be able to recover all or a big part of his legal costs from the State of Victoria.
And it’s also possible he could get compensation for his time in prison, the destruction of his health, the slur on his character etc.

I hope Pell’s accuser reads that statement and draws satisfaction from it, because it expresses, in no uncertain terms, what the Premier thinks of Pell.

We had the same “We believe you” appeal from the police in the UK when they were investigating the supposed paedophile ring in Westminster. And where did that get us ? In the end the accusations that were ‘believed’ were shown to be fantasy and lies.

The statement from the Premier of Victoria is shallow, idiotic thinking. It is designed simply to appeal the emotive heartstrings of people, and has little or noting to do with real justice. Not just for Pell, but also for abuse victims, who deserve justice too. But, to apply sentimental thinking by someone like him to the real scandal of abuse does not help anyone. He should be ashamed. Surely we should expect more from people like him, rather than emotional grandstanding ?

Very interesting the comments about justice.
It is also the case that the reason the majority of child sexual abuse cases never get to conviction is that there will never be enough evidence legally to get a safe conviction.
My own first thought about Pell was to wonder whether the charges were trumped up as a punishment for actually having a go at straightening out the Vatican bank rather than appearing to, and the circumstances of the abuse seemed unlikely.
That said I wonder whether Christians should see what has happened as this case as justice, since they have reference to a higher court where the judge has no need of witnesses.

Pell has not been found “not guilty”. His conviction was found unsafe. The state if it wishes can conduct a retrial.

Pell is not guilty. That is the statement of fact in law. There is no point in us trying to double guess that or undermine it. To do so would do damage to a greater good, which is the law and justice itself, which has implications far beyond this particular case, and for each one of us.

I doubt if the state will reinstate these charges again and try Pell again. That would be interpreted as arbitrary and vindictive behaviour by the state, and in all likelihood interpreted as such a court and jury.

More interesting is what will happen with other charges, that may be on file, and could be brought forward ? Or fresh allegations that have not emerged yet, and may lead to charge. Interesting also will be civil cases brought against Pell. Usually the burden of proof in civil cases is lower than in criminal cases. It will be interesting to see how that goes.

Whatever, I don’t think Pell is completely out of the woods. He may not go to jail, but I suspect he will be sued in civil cases. His reputation is in tatters, rightly or wrongly – just a statement of fact. He will be dogged by these matters for the rest of his life. I suspect he will want to disappear in to the distance and hope that he can find some sort of peace and tranquillity, and eventually fade from memory. He’s not going to have a great last bit of his life, whatever happens.

Regarding redundant titles, the biggest cheek is that the British sovereign continues to use the title Defender of the Faith, which Leo X had awarded to her monstrous predecessor, Henry VIII, for upholding the Catholic Faith against Luther. Somebody purporting to be Magna had challenged me to “prove my point” regarding the historic title of Patriarch of the West for the Pope. What is there to prove? The title had ancient origins in the division of the late Roman Empire; thereafter was little used, and its status as a relic of the past was acknowledged by Benedict XVI when he dropped it. My understanding of the reasons are that, given the Church’s universal reach to all five continents, the title is Euro-centric; though my own view is that it could have reasonably been preserved on grounds of antiquity and continuity with the past. I now expect to be challenged on my reference to five continents, and asked to “prove” that. I am always happy to be corrected and informed, but the presence of several daily commentators on this blog with the obsessive mentality of “flat-earthers” so often results in an unproductive and unseemly slanging match rather than constructive dialogue.
