VICTIM OF FR MALACHY FINEGAN TO LAUNCH LEGAL ACTION AGAINST POPE AND CATHOLIC AUTHORITIES IN IRELAND.

Connla Young The Irish News 21 September, 2020

A victim of Malachy Finegan is to launch legal action against Pope Francis and Catholic Church authorities in Ireland.

The priest has been accused of sexual abuse across Co Down, including at St Colman’s College in Newry where he taught from 1967 and was president for a decade.

At least 12 young boys are thought to have been sexually abused while he was at St Colman’s, while many more were physically abused.

Finegan, who died in 2002, was also a parish priest of Clonduff in Hilltown in Co Down, where it is alleged he carried out further serious sexual abuse.

Concerns have also been raised that he may have been an RUC informer.

It emerged last year that the Public Prosecution Service had decided not to prosecute in eight cases following a police investigation linked to the activities of the former cleric.

The Irish News has now learned that one of his victims is to launch legal action against the Diocese of Dromore, the Archdiocese of Armagh, the Bishop of Rome and the Holy See, arising out of allegations of abuse.

Solicitor Kevin Winters, of KRW Law, said the outworking of a PSNI and Police Ombudsman investigation “has resulted in a huge loss of confidence that anything will ever be done to expose just how much the Church knew about Finegan’s activities”.

The solicitor revealed that he is “in ongoing communication with the PSNI on a number of issues arising from the investigation”.

Last year Catholic church authorities said a mosaic tribute to Bishop Francis Brooks, who died in 2010, was to be removed from Newry Cathedral following criticism of his handling of Finegan.

Images of the bishop, which were displayed in St Colman’s College where he was principal prior to Finegan taking over in 1976, were also removed.

Mr Winters said the response doesn’t go far enough.

“Removing photographs from walls and digging up mosaics are mere token gestures which go nowhere near remedying the justice deficit here,” he said.

“This case is being taken in order to try and address the real disappointment and frustration felt by many who took part in the criminal inquiry.”

The leader of the Catholic Church in Ireland, Archbishop Eamon Martin, has previously apologised “unreservedly for the hurt and damage caused to victims by Fr Finegan, or any other priest or church representative”.

PAT SAYS

It is good that this victim is taking this case against the Vatican and the Irish Church.

It will be a tough case but he has very good lawyers.

Managing to corral the Irish Hierarchy and evil Rome into the guilty corral will be difficult but will be achieved after a number of cases are brought against them.

Its a case of slowly, slowly catchee monkey.

Breaching the walls of the establishment is sadly, a huge task as they have all the money and power and influence behind them.

It will not be achieved by the first attack or the second.

It will be achieved as a result if multiple failed attempts by vulnerable but brave people.

The RCC is literally AN AXIS OF EVIL.

It has Satan and all that is evil on its side.

But in the end TRUTH, GOODNESS, JUSTICE will prevail.

“Good for ever on the scaffold,

Evil always on the throne.

But God stands within the shadows.

Keeping watch upon His own”.

Lord Jesus, who raises the lowly and the poor, and who casts down the mighty from their evil thrones, look upon this victim and all victims, and be their champion in their battle with the aligned forces of evil and deliver your Divine Justice for them in the Name of Your Blessed Cross. Amen.

I’m pleased to hear of this action. Exposure is the only recourse in face of continual intransigence of the RCC. I had relatives at Colman’s during Finnegan’s time there.

The Case Of The Pope: Vatican Accountability For Human Rights Abuse
Geoffrey Robertson QC
Published: 14 September 2010

Geoffrey Robertson QC has had a distinguished career as a trial counsel and human rights advocate. He has been a UN war crimes judge, a counsel in many notable Old Bailey trials, has defended hundreds of men facing death sentences in the Caribbean, and has won landmark rulings on civil liberty from the highest courts in Britain, Europe and the Commonwealth.

“The Case of the Pope delivers a devastating indictment of the way the Vatican has been wrongly elevated to statehood and allowed to exploit its powers…

In The Case of the Pope Geoffrey Robertson QC delivers a devastating indictment of the way the Vatican has run a secret legal system that shields paedophile priests from criminal trial around the world. Is the Pope morally or legally responsible for the negligence that has allowed so many terrible crimes to go unpunished? Should he and his seat of power, the Holy See, continue to enjoy an immunity that places them above the law? Geoffrey Robertson QC, a distinguished human rights lawyer and judge, evinces a deep respect for the good works of Catholics and their church. But, he argues, unless Pope Benedict XVI can divest himself of the beguilements of statehood and devotion to obsolescent canon law, the Vatican will remain a serious enemy to the advance of human rights.”

Statement of Archbishop Eamon Martin, Apostolic Administrator, concerning the re-instatement of Canon Francis Brown (Wednesay 24 June, 2020)
In May 2018 Canon Francis Brown voluntarily stepped aside from all pastoral duties to facilitate the full investigation of information that had been received regarding a historical safeguarding concern.
Canon Brown and the Diocese of Dromore cooperated fully with the statutory authorities responsible for investigating such matters. Following a full investigation by the relevant authorities, no charges were brought by the Public Prosecution Service with regard to Canon Brown.
The Diocese of Dromore then initiated the Church processes that are required in such cases and these have also concluded that the case against Canon Brown is unsubstantiated. This means that he can immediately return to ministry.
I know that Canon Brown has been greatly supported by the prayers and encouragement of many over these past two difficult years. I would ask you to continue to support and help him to settle back in as he begins to resume his duties. I am grateful to Fr Des Loughran who stepped in as Administrator for the duration of Canon Brown’s leave and to all who have helped in any way.
This has been a difficult time for all involved and we offer our prayers for all concerned. The Diocese of Dromore continues to recommend anyone who has suffered abuse of any kind to report it immediately to the local Health and Social Care Trust, and to the PSNI.
They may also contact the Safeguarding Office of the Diocese of Dromore on 07789917741.
The Catholic Church also provides confidential services for those who have suffered abuse through Towards Healing and Towards Peace. Towards Healing is a confidential service for those who suffered abuse and can be contacted on 0800 0963315. Towards Peace offers spiritual guidance and support to those victims who wish to engage with their Church and can be contacted on +353 (1) 505 3028.
Statement of Canon Francis Brown
On 14th May 2018 I was informed by Bishop Boyce the Apostolic Administrator that an individual had made an allegation of a historic nature against me. In accordance with Church guidelines I voluntarily stood aside from my duties on 19th May 2018 to allow this allegation to be investigated by the Civil and Church authorities.
A period of over two years has now passed and during that time I was spoken to on one occasion by police and once separately by the Church authorities. Otherwise, during that time. I remained at home while the investigation of the allegation took place. I accept that these procedures must be rigorous and thorough and that they must be conducted with transparency and diligence.
On 9th August 2019 the Public Prosecution Service confirmed with me that they had looked into the investigation carried out by the police and that they intended to take no prosecution against me whatsoever. Their file was closed.
Thereafter the Church authorities conducted further investigation into the allegation made by the individual and I have been informed by Archbishop Martin on 23rd June 2020 that, following an investigation by the Diocese and further consideration by the Holy See at Rome, there were no grounds for me to remain out of Ministry. I was invited by the Church to return to my duties as a priest of the Diocese of Dromore.
I wanted to take this opportunity to explain to my Parishioners, fellow Priests and Deacons that, during those two years and more which have gone by I co-operated fully with any of those who were deployed to investigate this matter.
Since May 2018 I have stated publicly and repeatedly that the allegation against me was false and completely without foundation. The various investigations which have taken place by Civil and Church authorities have confirmed that I spoke the truth about this matter from the beginning.
I welcome this opportunity to thank all of those who supported me through this very trying time including all of the Parishioners of this parish and beyond, my fellow Priests, Deacons, Religious, my many friends and family who have reached out to me with support and encouragement. I extend a very sincere word of thanks to Archbishop Eamon for his support and the great empathy he has shown me since he became Apostolic Administrator of the Diocese. A word of thanks also to my brother priests, Fr Des, Canon Hackett, Fr Kryzsztof, Fr Colm, Fr Robert, and Deacon John for their work in my absence.
On a personal note, I say that I was forced to walk through a dark valley which challenged me in many ways. I was comforted by the fact that I knew that what was said about me was untrue and that I spoke only the truth from the outset.
I am of course incredibly pleased that the just outcome has arrived at last. I want the Parishioners and all my fellow Priests and Deacons to know that I will be returning forthwith as the Administrator of the Parish of Newry. I look forward to fulfilling my work as a priest which I have done faithfully since my ordination on 9th June 1974. I have always been, and I remain, a priest in good standing. Thank you,

Has there been no investigation into the individual who made the allegation? And if not, why not, individuals who make malicious allegations should be prosecuted for wasting police time never mind the what they did to their victims. What Canon Brown an innocent man was put through for over two years was disgraceful. So the individual should be prosecuted.

Bella, bishops who deliberately covered up child rape and abuse of vulnerable adults committed by priests, should they be investigated and prosecuted? Should every diocese in Ireland be investigated?

That is your real concern, isn’t it Bella? The accused priest? Not the accuser, whom you condemn, without a shred of evidence, for having acted maliciously.
Despite your adamant protests on this blog about your concern for victims of sexual abuse by priests and your desire to have these criminals removed from ministry, I don’t believe a word of them. You would defend these men to the hilt, just because they are priests, even had they raped hundreds of children; and you would ruthlessly cast these children aside to do so.
You are an apologist for evil.
Sexual abuse can be very hard to prove. When it cannot be proved, it does not necessarily mean that it did not occur. A presumption of innocence is not a declaration that a person is actually innocent. And an unproven allegation does not always mean that no crime occurred.
Your intemperate and unjust words on this blog today can only hurt those who have been raped by priests, but who cannot prove the crimes against them, because such victims typically do not report them before all forensic traces of them have gone.
That you attacked this accuser as malicious, without any evidence for such an allegation, and that you went on to call for his prosecution, shows that it is you who is acting from malice, to gain vengeance.
But it is what blog readers have come to expect from your vile and evil mindset.

Like

@11:55: To be fair, the comment @10:38 did not specify that THIS allegation was malicious: only that malicious allegations should be prosecuted. And I’d agree with that.
Having said that, I have sympathy with the general thrust of your comment with regard to the individual in question.

Bella, you have already made your point on this topic and, as usual, made it poorly and unconvincingly.
I have sympathy with anyone wrongfully accused, provided he or she is wrongfully accused.

An unproved allegation isn’t necessarily an untrue one.

Yes, there most assuredly is something wrong with such a notion because, quintessentially, it is a pagan cult of Romanist priests.
Not for nothing does the supreme priest of this cult, the pope, refer to himself as ‘Pontifex Maximus’, the title of the pagan chief priest in Ancient Rome. And the College of Cardinals, too, is modelled on this pagan priesthood.
Imperial, pagan Rome lives on in this cult. But its star is waning. Happily. 😄

Ultimately, as followers of Christ we accept that God is our ultimate judge who, as scripture says, will reward or treat each of us according to our (life) behaviour and what we each deserve. While all of us personally must call out wrongdoing – always – which most of us do, we cannot dispense our judgment. We cannot play God with others. Not your lesser concern for those raped by your fellow priests and the crimes covered up by your fellow priests; that was all for show, a mask for your own selfish concern. You even finished that last sentence with a flourish: an exclamation mark to express what really mattered to you.

You are not a follower of Christ, priest: you follow a globally shamed and discredited institution, because you freely, and willingly, vowed or promised obedience to a man, a bishop and his successors, rather than to the one that counts: the God-man, Jesus Christ.

You’re a total fraud, priest. The last sentence of your post proves this.

There were no priests in the early church, priest; no parasites: just followers who came together to break bread and to drink, likely from a communal cup.
