President Michael D Higgins in Ireland has signed the Mother and Baby Bill into law.
The government won a Dáil (Irish Parliament) vote on the controversial bill by 78 votes to 67 last week.
A presidential statement said concerns raised in the discussion of the bill were “serious and must be considered”.
The legislation relates to records gathered by the Mother and Baby Homes Commission.
Much of the evidence it heard was given in private and legally protected.
A database of 60,000 records is to be transferred to the child and family agency Tusla, while the remaining records will be sealed for 30 years.
But campaigners on behalf of the mothers and their children have expressed fears they will not be able to access their records if they are sealed.

The Church which was given the responsibility of looking after the “outcasts” of a miserably, harsh, judgmental, merciless society, underpinned by colonial Victorian values. Society as a whole approved of these institutions. Public moral failure was frowned upon and punishments were cruel, with civil, medical, legal and ecclesiastical powers conspiring together to consign our “problem women and children” to stay locked behind walls. Systems of care, accountability and surveillance were not standards of management. Who really cared about the level of professional training given to religious in psychology, child psychology particularly, trauma stresses, cognitive dissonance, the effect of child separation. No one from the various Departments sought to critically analyse the reality of these institutions. Whatever combination of factors which contributed to the deep pain, hurt and trauma, the Church should have had the highest standards of caring. Sadly, that wasn’t the reality. As a society we struggle with owning our collective responsibility for our past cruelty inflicted on our very vulnerable, especially mothees and children. The Church, yes, shamefully broke the spirit of many, many people. So, the political decision of recent times reveals that we don’t truly listen to those who matter most. I am shocked that the Predident signed this Bill. There was plenty of concern expressed about the consequences of signing it into law. The Green Party TD got this so wrong by not listening to the relevant voices who are hurt, pained and trampled on once again. This government is out of touch with the mood and feeling of its citizens. This is a dark chapter of our history, institutionally, politically and collectively. We must raise our voices higher and ensure no further pain is endured by survivors.

At 11.19, might it be that Higgins and others were restricted by the Commission’s terms of reference, especially the legalese surrounding it?
My understanding is that the Commission had to give certain legal gurantees to those who wished to communicate their information privately, otherwise its report would not have been as comprehensive and as informed as it is.
I am not defending the sealing of records; just attempting to contextualise it legally.

What are these church created ‘orphans’, and the ‘shamed mothers’ who were often turned out of their father’s houses on to the street, to do? Motherless infants were turned into anonymous institutional products and girls were turned into fatherless street people on the say of men who remained trapped in their own mother love and rejected women in general. Now the irish state is saying with its thirty year rule that these mothers and infants will only be reunited In the graveyard. The irish ‘Free State’ has a long way still to go to become a republic.

This disreputable bill is open to challenging in the courts and I hope some advocacy groups will pursue this option. How did other Western societies, whether Catholic or not, deal with single mothers and so-called unwanted pregnancies in the first and middle parts of the 20th century? In Britain they were vilified, sent to homes, cast out from families, shunned. Even now the Daily Mail and many Tories deride them as feckless spongers.
More importantly, what septic tanks did the 6,666 babies aborted last year in Ireland end up in, or did they go to hospital incinerators as clinical waste. Perhaps in years to come another amateur historian will expose that grisly truth.

Ah, bless, another seemingly innocent lamb to the slaughter. When I see these pictures of young, earnest, monks or seminarians, I wonder to myself where they will be in five years. The vast majority will have high tailed it off to another kind of life, either because they see the light or because they get themselves in to trouble. The ones that stay are, well, questionable, limited, compromised, scared of the world, odd, nutty, OCD, prissy, or a.mix of them all. The clerical or monastic life is not a place for a young man to serve God these days. It’s too compromised, as we see day in an day out.

Bishops in Ireland and the UK are making noises about the ban on public worship during the lockdown. I wonder is it because they really care about worship, or whether they are just not used to being told what to do ? I suspect the latter. They have, and have had for a long time, such an elevated view of themselves and their authority, seeing them and their church almost as an alternative nation within the nation which they control and order. They’ve not caught up with the new reality where they and their church doesn’t really figure anymore in the public space and conversation. They have removed themselves from that territory by their behaviour and subsequent loss of trust. Nobody listens to them anymore. Certainly not in Ireland on anything of national importance – including issues such as marriage, divorce, sexuality, abortion, relationships……. Well, like the rest of us, they are going to have to accept that in the interest of the common good (which they bang on about endlessly on other issues) they cannot have their way and will just have to do what the rest of society is doing. Stop moaning. Stop finding fault. Knuckle down and shut up. Oh, I forgot another reason they might well be kicking up a fuss. Money. Of course !
