SQUATTERS RIGHTS?

Squatters rights is a crude colloquial expression for what the law itself, calls ADVERSE POSSESSION.

I think the law varies in each jurisdiction but the following things are important:

1. The claimant must have had possession of the property for a minimum of 12 years.

2. The claimant has had exclusive control of the property for that time.

3. The owners of the property must be aware that the claimant is in possession.

4. The claimant must use the property in such a way as to display his intention to own the property

5. The claimant must never have paid rent to the owner.

6. The claimant must not be in possession of the property through any form of force or threat.

APPLYING FOR ADVERSE POSSESSION

In the UK people apply through the Land Registry Agency.

There is a form to complete and a strong body of evidence required.

If you afford a lawyer all the better.

But you can represent yourself as a personal litigant.

Thats not an easy task.

SPANISH BISHOP LEAVES TO MARRY EROTIC AND SATANIC NOVELIST.

When Spanish bishop Xavier Novell resigned last month, the Roman Catholic Church cited strictly personal reasons without going into detail.

It has now emerged in Spanish media that he fell in love with a woman who writes Satanic-tinged erotic fiction.

In 2010 at the age of 41, he became Spain’s youngest bishop, in Solsona in the north-eastern region of Catalonia.

He has backed so-called conversion therapy for gay people and carried out exorcisms.

Seen as a rising star in Spain’s Catholic Church, his decision to resign with the Vatican’s approval came as a surprise last month. He is said to have met several times with Vatican officials as well as the Pope himself.

Xavier Novell was traditional in his remarks on abortion but his strident views on homosexuality and outspoken support for Catalonian independence were controversial.

It came as a shock when Religión Digital reported that he had fallen for divorcee Silvia Caballol, a psychologist and erotic novelist. The news site said that the former bishop was now looking for a job in the Barcelona area as an agronomist.

Caballol’s books include titles such as The Hell of Gabriel’s Lust and the trilogy Amnesia. In the blurb for one of her works, the reader is promised a journey into sadism, madness and lust and a struggle between good and evil, God and Satan with a plot to shake one’s values and religious beliefs.

Neither the ex-bishop, who is now 52, nor the novelist have responded to the reports although Religión Digital quoted him as saying “I have fallen in love and want to do things properly”.

The diocese has since responded by emphasising that “corroboration or not of this story is a strictly personal matter for him alone”.

The issue has again raised the issue of celibacy within the Church. In earlier interviews, Xavier Novell admitted that in his youth he had fallen in love with an 18-year-old girl and he had later wanted to marry and have children before deciding on a different path.

His change of heart has prompted grumblings within the Church. Dominican nun Lucía Caram said he was “out of his mind” and criticised his promotion of “conversion therapy”.

I have a non disclosure agreement with a major UK Government Department in NI that I used to work for. I complained about an equality matter and went to court. After a bit of to and fro, we settled on the steps of the court about two years after it all started.

In return for a quarter of a million, I agreed to resign but was also required to never reveal publicly any matters to do with the case or the issue complained about.

The great thing is that the NDA applies also to them as the other party, so they cannot talk about me or diss me either.

The even better thing is that I didn’t have to pay a washer in court fees – my union took on the case and paid it all.

And the really, really best thing is that I am now working for a different Government Department, doing more or less the same job, and on a higher salary than the job I left. The NDA means I am not obliged to refer to my departure and the former employer cannot mention it in their reference.

And yet the fool says in his heart that there is no God?

@12:17. Is your story the full story? I ask as I thought that if one retired with a pension then resumed in a different government job, the pension from former job would be cut. In effect, one was barred from receiving both a full government pension and salary simultaneously.

Hi 5.45pm, you are right about the pension. I didn’t get an immediate pension as part of the settlement. The payment was a lump sum and was an ex-gratia payment made without any admission of liability. There is no ongoing payment, however the pension I earned in the alpha scheme is preserved and will be paid in the usual way at age 60.
In my current role I am paid my salary for the and accrue pension benefits under the new scheme, which will pay out when I’m 67. My two periods of service are not linked.
My payment was the largest that the union’s lawyers had ever heard of, and it reflected the gravity of the issue and the employer’s extreme reluctance to have it played out in public.

Also, I was previously employed by the Home Civil Service but the current job is in the Northern Ireland Civil Service, a totally separate entity albeit with very similar terms and conditions. I was very glad that I was in a union. They paid for a solicitor and a QC, because the Crown Solicitor’s Office engaged a QC, so the whole thing must have cost a fortune, though I never asked how much.

I recently acquired a house and land under adverse possession. It was a long hard fight and the lawyers cost me a fortune. But it was a matter of principle. I would dread having to go through the whole process again. It was unbelievably stressful.

What legal basis did you have for obtaining a copy? The report is made available to anyone with “proper interest” this is NOT a public docunent.

I am a citizen of Ireland conducting enquiries into the circumstances surrounding the death of another Irish citizen – with a concern that other people may have been affected by the illness and death of the deceased.

I know more than you Pat. If an inquest was held then the report and all other evidnece tendered during the hearing is public by virtue of the fact an inquest is held in public.

Imagine the state of affairs of the already toxic institution had you not come under the radar for expulsion sooner.

Official reports of inquests
As inquests are public enquiries, it is possible to obtain a copy of the post-mortem report and any depositions taken at the inquest, including a copy of the verdict. These official reports are only available after the inquest has concluded. There is a small fee for these documents. Inquest papers are not available before the inquest has been held.

Pope Francis has suggested (allegedly and apparently) that the bishop has himself been influenced by evil and Satan and an exorcism might be in order to bring him back to his senses (the bishop himself had an exorcism ministry).
That may be but perhaps being party to covering up clerical sexual abuse in Chilie and Argentina requires an exorcism too – a deed of the dark if ever there was one – we see the devil at play when it is convenient to place blame and explain errant behaviour.
I think if the bishop receives an exorcism so should Pope Francis and every bishop, who I fear are deeply and darkly committed to cover up and concealment.

1. September 2018 since when there has been no more Communion, pulled the ground from under the feet of hitherto decent suffragan bishops, priests and seminarians in quiet places. They now know this. The only way I can help them is by mentioning it from time to time.
2. A gent who was trying to “obtain possession of” this blog by not addressing ongoing issues made it clear he is in fact an arch Vatican City Statist himself. Priesthood only ever was a decoy in the eyes of the Vatican City State and its foreign partners, and this gent never intended to sway the “vatibots” but to collude with them.
3. Bp Pat, you modestly diverted attention from the main benefit at your Oratory, namely that you do not have Vatican City State baggage. (I think public sentimentality about “sacraments” dangerous with “intercommunion” looming, and with religion becoming more – not less – politically charged.)

The lady the bishop is to marry is v attractive – the boy did good – let’s see if their union lasts. He bailed out on his ordination vows whose to say he won’t bail on his marriage ones.
Time will tell I guess – although I’m sceptical about his episcopal rise as I’m sure that’s dependent more on the episcopal gay lobby in Spain, which Martel confirmed in full swing, if uiu pardon the expression.

Why is the Abbot of Mount Melleray at the ordination in Killaloe diocese? His former abbey, Roscrea, is in the diocese of Killaloe. Does this mean that he still has some sort of jurisdiction over Roscrea since the community in Roscrea still has no abbot and appears to have been downgraded like a sub post office

7:35, Roscrea was founded by monks from Mount Melleray. Roscrea is seen as a daughter house. That is why Mount Melleray were able to elect the abbot of another monastery as their abbot.
His 6 year term as abbot of Roscrea would have ended in June this year. He has at least 2 more years as abbot. ☹️

I’ve been thinking about squatters rights and the crisis in housing and the sensitive subject of church property.

I read of a Russian Oligarch who annoyed his neighbours with his plans for his county estate which impinged on locals property and freedoms. They protested but he won but has agreed to build 25 houses for first time buyers.

It made me think of the Catholic Church whose true wealth in property must be off the richter. The Vatican alone has over 5000 properties world wide and I imagine each diocese has a surfeit of land and buildings.

Wouldn’t it be amazing if homeless people could first squat and then own some of this property?

How many presbyteries are empty in Ireland?

The church does token work in this area but imagine something daring and imaginative and even pushing the law to breaking point by encouraging squatting and taking back the land and property and distributing it to the homeless.

I have noted that clergy click the plumb parishes and they are often given to priests who are in favour and not so plumb given to those who are on the margins, not in the circle of trust or patronage.

What was the hurry in appointing that man as a Bishop? I thought they only appointed them so young in places where there was a shortage of qualified candidates. There surely was someone in their 50s who would have been suitable, that would have prevented this whole fuss.
As for adverse possession, people look down at it with the term “squatters rights” because of the naïve and limited idea most have about the purpose of law. Sometimes justice is really served by not depriving a person of something which for all intents and purposes had been theirs in all but title.

Pat, when you were ordained, and started out as a curate, did your room in the presbytery you lived in come furnished or did you have to buy your own furniture? In Clogher newly ordained priests were sent to unfurnished houses and had to buy their own furniture which they took from appointment to appointment. I am not sure if that is still the case, though.
Also, do newly ordained priests get a terms and conditions document telling them where they are going, what they’ll be paid and what is expected of them and what they can expect from the diocese, or are they just thrown in at the deep end?
