DEENIHAN DROPS ALL CANONICAL CHARGES AGAINST SILVERSTREAM WHISTLEBLOWER !

Within hours of the Gardai and Proseecution Service deciding not to prosecute Kirby over his sexual advances towards Dom Benedict Andersen Tom Deenihan withdraws all canonical charges against the whistleblower!

So, the whistle-blower has done nothing wrong.

Then why is he cast out of his monastery and forced to live 3,000 miles away from it with very little financial support and depending on his family?

The truth is that his only “crime” was speaking out about Kirby’s sexual advances towards him.

He had no option but to speak out as no one within the Church was willing to listen to him and act.

To this day he fully stands over his statement that Kirby was targeting him sexually.

And Kirby has history with this behaviour everywhere he has lived.

LETTER TO BISHOP OF MEATH.

Dear Bishop Deenihan,

In light of my posting on today’s blog, I was contacted by an individual who provided me with some interesting insights about Silverstream and Dom Mark Kirby. He suggested that the recent posting on the website of Silverstream Priory has arisen from the decision of the Director of Public Prosecutions not to charge Dom Mark Kirby, OSB. Is that an accurate summation of the facts?

However, I was also contacted by one of the priests of the Diocese of Meath, who informs me that it was YOU, Bishop Deenihan that referred Dom Mark Kirby to An Garda Síochána; it was NOT Dom Benedict Andersen, the Silverstream whistleblower. Is this true?

The first caller who is not a priest told me that it is possible for people with standing to submit a “Request for a Summary of Reasons” to the Director of Public Prosecutions to understand their decision-making not to prosecute Dom Kirby. I imagine this includes you, Bishop Deenihan, and Dom Anderson. Is this correct?

Upon receipt of this request by the DPP, a lawyer within its “Victims Liaison Unit” will write to the individual(s) giving a summary of the reasons that informed its reasoning not to prosecute Dom Kirby. The Office of DPP advertises this will usually occur within twenty-eight (28) days. Thereafter, it is open the complainant(s) to seek a review of the decision of the DPP not to prosecute Dom Kirby.

Such a review (if requested) will be carried out by a lawyer who was not involved in reviewing the evidence against Dom Kirby in accordance with the “Guidelines for Prosecutors”. If, and when a review has been completed, the reviewing lawyer will then write to the individuals with their decision. It is stated that a review will normally be completed within six (6) weeks of a request. But, in light of the pandemic, it is not unreasonable to suspect that there could be a conspicuous delay. Thereafter, on the outcome of the DPP’s review, the option would be open to the complainants to seek to Judicially Review the decision-making of the DPP, however, that is unlikely but it is important to keep all options on the table.

Bishop Deenihan, I need not remind you that the alleged actions of Dom Mark Kirby, OSB, towards Dom Benedict Andersen, OSB, adequately satisfied the threshold of sexual harassment. However, the actions were sufficiently serious for the police spent a conspicuous amount of time investigating the allegations.

We do not know what informed the decision-making of the DPP, however, we can legitimately speculate that the decision not to prosecute was possibly predicated on the grounds of Kirby’s known ill-health.

The caller highlighted that the alleged actions of Dom Kirby (supported by written evidence) were tortious, and moreover, they are actionable before the civil courts in Ireland. Thus, he left me with the impression that it is open to Dom Andersen to initiate civil proceedings against: i) Dom Kirby; and, ii) vicariously against the Diocese of Meath; because, a) there exists a sufficient relationship between the tortfeasor (Kirby) and the defendant (Diocese of Meath) and, b) there is also a sufficient connection between that relationship and the tortious conduct. It could be interesting times for the Diocese of Meath should this matter come before the civil courts. I, of course, would be happy to give evidence if I was invited to do so upon receipt of a subpoena. Consequently, it may-be the case that an Irish court room is the appropriate and most suitable forum for these matters to be appropriately ventilated.

As Lord Phillips, the President of the Supreme Court United Kingdom remarked in Various Claimants v Catholic Child Welfare Society “The law of vicarious liability is on the move”. In light of advice received from counsel in Dublin, Catholic Child Welfare Society is a sound statement of legal principle that can be called in aid before an Irish Court. In the judgment of the Irish Supreme Court in Hickey v McGowan, the Court clearly stated that “the close connection test must be taken to represent the law in Ireland”. The Irish case was one where vicarious ability was imposed on an employer for acts of sexual abuse perpetrated by an employee. There is a clear direction of travel that can be pursued.

As you are aware, the burden of proof in a civil case is conspicuously lower than a criminal matter. In light of the known misbehaviour of Dom Kirby before his arrival in Ireland and the failure of the Diocese of Meath in the person of your predecessor, Bishop Michael Smith to undertake the most basic background checks; the optics look appalling.

In conclusion, Bishop Deenihan, would you agree with my suggestion that the statement on the website of Silverstream Priory was deeply imprudent, ill-advised? You would also accept that it would be imprudent for the Diocese of Meath the think just because the first decision of the DPP would appear to be favourable towards Dom Kirby, a second review could beget a different decision? And, if that is the case it will be another marker on a saga that shows no sign of abating any time soon.

I’ve heard others who have been observing what has happened with the OCSOs talking about a shift in the balance of power, almost as if it could not conceivably have been thought possible that things like this would happen, but seeing that it has happened. And, somewhat open-mouthed and gobsmacked that this has happened. I think there will be a lot of reassessment and readjustment taking place in clerical and episcopal minds about the change in the ‘landscape”. No longer is it little dirty scandals and the sexual peccadillos of clergy that are being talked about, which can be shrugged off by silence and just shifting characters in to being MIA or c/o. No, it’s some bigwigs that have been uncovered and dislodged, powerful and influential people who previously would not have been subject to such forensic investigation and action – the Abbot of a premier monastery in Ireland, and the Abbot General of the Cistercians. That will send some earth tremors beneath the feet of many clerics who thought they had power, authority and protection. No longer are they unaccountable.

One of the consequences of the post-Vatican II collapse of vocations is that the pool of eligible candidates for appointment as a bishop or religious superior becomes much shallower, which allows unsuitable candidates such as the current dull crop of Irish bishops and people like Phonsie and Tom D and abbots like Dick and Malachy to be selected. In some cases, such as Mount Melleray and Roscrea there is only one candidate or no candidate at all.

The ‘except’ is the key word. Paul VI forbade various things ‘except’ in rare circumstances, and this acted to legalise such enormities as Communion in the hand. Any long established traditional Mass takes place in a personal parish or similar, say an Oratory of St Philip Neri. It seems to have the intent of segregating, forbidding ‘bination’ or the offering of both New Order and tradition. I see this application document as confirming that TC is an unworkable annoyance. A generation of elderly priests see the New Order as their baby. They are variously going gaga (eg Fr Foley) or dying. The men of TC are joining them. TC is the siren song of a dying generation. It’s a sort of vengeance for Roche who as bishop of Leeds closed down parishes offering the traditional Mass or which were too successful and orthodox. All those old priests excited that the TLM will disappear are just going to be disappointed. Younger priests either quite like the TLM or don’t care. It doesn’t live rent free in their heads. Either is good.
What Pope Benedict intended, although mocked by Spirit of V2 people and traditionalists, works, with Ordinary and Extraordinary Form. This document is hypocrisy on stilts talking about moving away from liturgical contention.
I hope Fr Andersen must be given justice, perhaps a place in a Benedictine house, say St Benedict Abbey, Still Water MA (https://www.abbey.org/), which has NOM and LOTH in Latin, alongside a well structured balance of work and prayer, if he wishes, perhaps a parish, and definitely a good sum of money. If +Deenihan has to put together a pile of money, a big pile of the purple coloured notes, he might look carefully at Silverstream and ensure it be de-Kirbyified at least. Maybe make Fr Andersen an Abbot, or at least a consultor, of one of Ireland’s creeper paradises, so that changes. Fr Andersen probably wants far away from Ireland or wherever Kirby is now. Monasteries purged of pervs, drunks and weirdos, without even some liturgical or spiritual magic, are attractive places.

In reply to the question at 4:04pm on yesterday’s blog regarding the 3 day pilgrimage to Lough Derg, the answer is approx. 5000 we’re doing the 3 day before Covid, with a further 5000 attending the one day retreats. Not viable anymore.

Yes, whistlebliwers are very vulnerable in all walks of life; we have seen the disgraceful, harassing and despicable manner in which Gardai, health care personnel, clerical personnel and private citizens in various walks of life have all been treated, almost like liars and criminals. In relation to the issues of the blog these days, I believe there are still more questions which deserve clarification. However, we must be careful not to extrapolate a new story with our own biased judgments. If what is printed by the Silverstream Priory is true, then we must be careful in our interpretations. Why aren’t questions put to the DPP? Why not ask the Gardai and the Charities Regulator if we are distinctly unhappy with the DPP’s decisions? I am certain the monks at the priory and other minasteries are in deep reflection about their identity, mission and their spiritual integrity. Mistakes and moral failings have occured. Misappropriation of funds has also been in the spotlight. I cannot envisage any person or persons in these dramas not to be affected and who find themselves in a very dark and uncertain place. Perhaps, in our charity, we should pray that the right decisions will be made and that some evident newness of reform and witness to Christ will transpire. For those of us who look on at these events, our last few Advent days should also be ones of inner reflection and prayer for our own spiritual wellbeing in the eyes of God.

it must be like trying to deal with Episcopal leaders following disclosure of such abuse.
A fundamental problem is lack of charity. Does the spiritual emotional psychological physiological social or moral well-being of survivors of clerical abusiveness matter?

1.26: I did not deny the exlerience of darkness or uncertainty in the lives of victims/survivors. Stay with the issue of the blog for today. Having been abused as a teenager over a two year period, I understand, probably more than you, the dark places of life. That aside it would be helpful to focus on the blog content for today. I stand by every word I expressed at 12.59. We do need, as Christ-like people to restrain our propensity for revenge. For me personally, mercy, forgiveness and human kindness are essential as means to finding healing, light and hope. I suggested that all of us – Christ-followers – ought to take seriously John the Baptist’s call – prepare a way for the Lord. Often we are too quick to tell others but not ourselves!!!

Did it ever cross your mind, maybe, just maybe, healing, light and hope will only come through change? Maybe John the Baptist’s call-prepare a way for the Lord-is a call for a fresh approach to the brokenness in the Body of Christ, particularly towards those ‘little ones’ through which Christ is very deeply wounded?

Pat, this is a very important blog. You are highlighting the use of state process to exculpate wrongdoing. The fact that the DPP has declined to bring prosecution (for the moment) gives Silverstream the thinnest veneer of credibility. But that could change if people with standing request the DPP to commence a review. This is the view of my brother who is a solicitor. He agreed with your blog posting, and in his mind whoever is advising you as a very good knowledge of criminal procedure. He also thought it was very stupid of Silverstream to have placed such a statement on their website until all the statutory timeframes had elapsed. He also felt it was evident that Silverstream had not taken legal advice about this posting, because it could still all go badly wrong. Now that Andersen has been rehabilitated he could make life very difficult for Silverstream and the Bishop of Meath. This could get very ugly (but hugely entertaining) if Andersen wants justice.
