In plain sight – the paedophile headteacher who escaped justice for 50 years

The Marist Brothers and Fathers have educated prime ministers, judges, cardinals and All Blacks at their prestigious Catholic high schools. But their record of sexual abuse is horrific. Worse still was their handling of the abuse when it was exposed. In this series, The Secret History, Steve Kilgallon investigates the power, abuse and cover-ups at the heart of two highly-influential and wealthy religious groups.

Warning: This story may be upsetting to some.

He was an exceptionally good teacher who brought history to life, who could spark teenage boys’ interest in Aristotle, Plato, Marx and the Reformation. He taught in some of New Zealand’s best-known schools, and ascended to be rector of one, St Patrick’s College Silverstream, a prestigious boys’ high school in Wellington. He lectured at Victoria University. He died with a glowing reputation, eulogised as a “brilliant and inspiring teacher”.

Francis ‘Frank’ Durning was “a very fine scholar”, Sir Tipene O’Regan recalled in his autobiography; Durning’s Christian theology classes were “one of the most liberating intellectual experiences of my life”.

Another former pupil always credited Durning as the teacher who transformed him “from an average student to a boy who topped his class”.

But Durning was a lifelong paedophile. His record was so lengthy, it seems incomprehensible that his behaviour was not known at the highest levels of Catholicism.

FRED THE FIDDLER

The present head of his order, Tim Duckworth, now denies ever telling a survivor of Durning’s abuse that his nickname within the Marist Fathers was ‘Fred the Fiddler’. Several former students, however, recall Durning being widely known as ‘The Fiddler’ and ‘The Groper’

Durning never faced the courts, police or even internal sanctions for his behaviour before he died in April 1999 at the age of 84. His story illustrates how entrenched paedophilia was in some Catholic schools, and the generational impact the abusers had even after they were long retired.

Durning was rector of Silverstream, and then vice-rector of its brother school, St Patrick’s College Wellington (known as ‘Stream’ and ‘Town’), both owned by the Marist Fathers.

Former pupils say his behaviour was common knowledge.

Everyone knew what was going to happen when you went up to Fred Durning’s room,” says Roy*, now 76, who was a third-former at St Pat’s Town in 1957, where Durning had moved a year earlier from Silverstream.

Every new arrival was given an appointment to visit Durning in his study-bedroom for a facts-of-life talk. When Roy arrived, Durning fondled his genitals. “It almost seemed an acceptable thing. I never said anything to my parents … It’s a wonder someone didn’t. Maybe they did?”

Mike Nicholas also had the summons. Durning pulled him close, pressing his erect penis against him, before Nicholas broke free and ran from the room. “It threw my head,” he says. “I felt so uncomfortable. What did I do to cause that? Durning was a very intelligent man, and he deliberately cultivated this image of being a holy priest… it must have been me, I thought [that caused his behaviour].”

Only after counselling many years later, in which he was invited to imagine ‘flushing’ Durning down the toilet, did Nicholas come to terms with the incident.

Another former pupil recalls: “I was outside his door once and a student came flying out of his room and said ‘you’re not going to get your hands on me, you dirty old bastard’.”

Roy wondered why nobody had complained

But perhaps they already had.

Before his arrival at Town in 1956, Durning had been rector – headteacher – of Silverstream from 1950 to 1954.

One of those he abused in those years was Pat Cleary. Cleary gave evidence, albeit posthumously (he passed away at the age of 82 in July 2020), to the Royal Commission currently enquiring into sexual abuse by the state and religious institutions.

Cleary, who said Durning had molested him and demanded intimate massages when he was a third-form student in 1951, and that another Marist Father, Patrick Minto, had kissed and cuddled him, was convinced two contemporaries had “blown the whistle” on Durning to the authorities, and Durning had been swiftly removed from the school to avoid further controversy.

The Catholic Church failed in an attempt to have much of Cleary’s testimony struck out and the names of Durning, Minto and others suppressed in the Commission’s transcripts.

Tim Duckworth said they wanted five names – including Minto’s – suppressed because they had no cases of abuse upheld against them and they “considered it similar to a person having name suppression in a court hearing until the evidence is heard.” He said he would welcome anyone with complaints about Minto to contact him.

Durning definitely departed Silverstream midway through the 1954 academic year. In 1955, his Rector’s Report in the school magazine thanks a Mr Watson for “accepting my invitation to come to our assistance when I was going on leave” and also, “I owe a special debt of gratitude to Father George who deputised for me during my absence from the school early in the year”.

Duckworth said he had no information that complaints were made about Durning in 1954. “I am happy to receive information that you are able to provide.”

Among the others Durning abused was Albert Lewis*. “Durning was 43 when I was at St Pat’s,” says Albert. “If he was abusing boys at three or four a year, he would have abused 200 boys.”

Now aged 83, Lewis says Durning is a name discussed when old boys gather. “This is a topic that can now be discussed around the barbecue,” he says. At one of them, a former classmate said at least 15 of his friends knew of Durning’s activities, or had been abused by him.

Lewis is convinced that Silverstream at the time was “like a crime ring”, citing Durning, Minto – whom he says was aware of Durning’s abuse of him – and the theologian Michael Shirres, later accused of multiple cases of abuse. He also named another teacher, also a Marist Father, of that time as an alleged abuser.

Responding to Lewis’s testimony at the Royal Commission, Tim Duckworth said: “I’m absolutely convinced when I read [his] evidence he believes we all knew about it all of the time. But I can and I would, if you wanted me to, and will subsequently show you that that’s not true, and couldn’t have been true.”

Asked about that declaration by Stuff, Duckworth said he would not comment on individual cases.

Durning would later teach at St Bede’s in Christchurch, spend time in Samoa (which later prompted former leader David Kennerley to promise to alert officials over there), and at Holy Cross College, a Catholic seminary in Mosgiel.

Mike Nicholas was studying at Holy Cross when a now elderly Durning arrived to deliver a lecture on the Reformation. He says Durning carefully avoided him. “I can really understand why people rave about Durning … he drew you right into it. It gave me a great appreciation, but I was still wary of the bastard.”

Durning was later appointed chaplain at Rochester Hall, a Canterbury University hall of residence, and lectured history part-time at the university.

Even as an elderly man, Durning continued to offend. Another former Canterbury student remembers arriving as a first year student and being asked by Durning to dress a ‘carbuncle’ on his inner, upper thigh. “I got out of there as soon as I could, and when the veterans arrived, I was warned immediately about him … told it was not unusual, and I’d had a lucky escape.”

Nicholas recalls one former Rochester student saying they had pranked Durning by turning on a communal shower then using a stopwatch to time how long it would take Durning to arrive to catch a glimpse of a naked student.

How can it be said that this apparently intelligent educated priest held any belief in the religious faith and teachings his “priesthood ” represented?
Such an extended history of abusive sinful behaviour, is the direct antithesis of Christianity.
Did he really believe any of the whole edifice of Christian teaching?
How does one explain not only his own blatant disregard for Christianity’s teachings, but additionally, the countless other RC clerical abuse constantly being revealed on a worldwide basis?
One might well argue that though they might have entered a seminary with well intentioned naive altruism, many clerics came to realise that religious beliefs are all a massive “con-job” but nevertheless the road to an easy prestigious lifestyle difficult to abandon. And having given up on religious beliefs, the whole God concept rigmarole, would it be right to say that the weaker kind of clerics maintained their public persona prestigious role while finding other “compensations?”
I find such explanations much more compelling than the “rotten apple” explanation scenario.
And I don’t think ALL clerics are charlatans. But I do believe many question the shallow nature of their religious beliefs yet maintain a helpful pastoral role more from personal generosity of spirit than religious conviction.

Spot on, MMM. What I find particularly outrageous is the misguided notion of paedophilic acts seen only in terms of sin. These abusive acts must be viewed as criminal. These individuals are dangerous needing to be monitored where possible. Superiors covering up for paedophiles in the priesthood are also criminals particularly if aiding and abetting by moving these individuals to different parishes, ministries, or countries. The Godfellah relies on human beings to do what is morally right and just.

I explained this to you before. It is the fact that these religious beliefs ARE credible to such vile perverts that matters supremely to them. They have to hold these beliefs as credible, otherwise they could not function as paedophiles/ephebophiles, while self-presenting as spiritually and psychologically adjusted about their immoral behaviour.
Roman Catholicism, from its early centuries, has dealt in a kind of perverse bookkeeping about personal sin and salvation. (Read the Irish Penitentials for a startling taste of this.)
Historically, every sin carries a penitential tariff, and this system still operates in the Roman Catholic confessional today. It’s subtext, despite what any priest might tell you to the contrary, is that God can be ‘bought off’ (‘appeased’) by acts of penance rather than by actual conversion. It remains a sacramental truism that, even though a priest may pronounce absolution over a penitent, the process of reconciliation with God is not completed UNTIL the person carries out the penance imposed by the priest (usually, some prayers). It is the penance, not the penitence, that ‘seals the deal’.
We have the sainted Jerome to blame for this corruption. In his vulgate translation, he misrepresented, in Latin, the Greek ‘metanoeite’ (‘repentance’ of sin, or ‘turning away’ from it) as ‘poenitentiam agite’ (or ‘do penance’ for sin). It is something the romanist church has never truly corrected.
The vile perverts featuring on today’s blog would have had their corrupted consciences stilled by the thought that, even though they sexually and recidivistically molested children, the fact that they were involved in good works, too, would have acted as a moral counterbalance to their sins. Would have cancelled the penitential debt, as it were, and, in good time, open the gates of Heaven to them.
Roman Catholicism has long taught reliance on priests, sacraments, and good works rather than on Christ. It is why marauding Normans, after wholesale and merciless slaughter of enemies, would sometimes have a monastery built, and installed an order of monks, to ‘buy off’ God, and, much more importantly, keep themselves from Hell. No need, then, for the laborious chore of personal conversion when there is available such a convenient short-cut.
Roman Catholicism is, arguably, one of the most corrupt and disingenuous forms of Christianity ever to have existed. And arguably, from the point of personal salvation, one of the most dangerous.

Yes @ 1.19, I well remember my boyhood phase of indoctrinated belief in confessional and other religious codswallop right up into 2nd Divinity when so much became apparent nonsense and I then really began to question fundamental matters of religious belief. That was over 50 years ago. And my conviction that it’s all a farrago of nonsense has grown stronger as the years pass with no convincing evidence for the objective foundations of religious beliefs: rather the contrary.
What you “explain” now, and previously is but part and parcel of the same intellectual and moral convolutional theological arguments much beloved by clerics: “wood and trees” comes to mind.

However, quite apart from problems with religious beliefs for any person, I believe some – all too many – sought a niche for their potential as educationalists through joining religious orders and it was a very respectable and “noble” career profession. Underneath the piety which I’m sure was genuine, these men who probably entered at 13 or 14 or 15…hadn’t psychologically developed. Nor would there have been a well grounded formation programme, concentrating instead in the harsher forms of spiritual discipline to curb sexual urges.The shame and guilt and damning of normal human contacts, often despised, turned young men into raging, conflicted sexual beings. I witnessed this as a scholasticate in a nivitiate at 16 years of age. I left after 9 months. I did not find the public confessing of sins to be good for my health. I can appreciate the sexual frustrations and subsequent destructive manifestations of such teachings and practises when these men turned to sexual abuse. That is just one strand of a complex issue..Where I became aware of sexual abuse on 2 occasiins, I informed authorities both civil and ecclesial – end of 1970’s.. Two persons were removed because I persisted. Their cleverness, manipulative machinations were scary and I was threatened because of what I witnessed. and reported. There is a horrible deviancy at play in paedophiles who mask it through piety. This story about the Marist Fathers is, yet again, very, very disturbing. I just hope that survivors will receive justice. I cannot fathom why any adult who may suspect abuse or engage in it can ever reconcile their behaviour with a religious belief…They are delusional.

And who might you be? The focus of this blog is abuse corruption and crime in the RCC
in Ireland and Internationally. A former social work child protection team leader who claims not to believe in the existence of God yet seems preoccupied with matters of religious belief is curious. Regarding religious or Catholic beliefs, everyone were different. But I think Catholic beliefs were somewhat diluted as time goes on.
He came from pre vat 2 which he should have strong Catholic beliefs or convictions. If he thought that his job was pastoral then his beliefs wouldn’t come into it. I noticed that re my experience with Cbs brothers whose lens they viewed their job as pastoral but they don’t normally talk about Catholic beliefs etc. Few of them ended up abusing deaf kids or had affairs with nurses including student nurses as well. It’s all about looking good at the exterior but not the interior side of it.
But I knew one Cbs who was very strong in his Catholic beliefs as he gave us ‘mini’ retreats. I recall he went to Maynooth to study theology and its mixed with lay women as well. It was only three years ago or two I found out that he got married as he left CBS. it was ironic that I met his brother who ran a shop in Galway which I learned more re him leaving etc. He was one of most decent cbs who never abused kids but he couldn’t do anything re abuses etc cos he was simply a low CBS with no influence.
He was quite skeptical re deaf kids abuse. But one cbs who worked with him directly and under his nose, went on to abuse deaf kids and ended up in court some 10 years ago.
Catholic beliefs has to do with the environment that we were growing up with etc. Also Catholic teaching was non existant when I was young, practically nothing whatsoever just barely scratching the surface.
Think Catholic beliefs were a lot stronger in pre vat 2 rather than now or any of the decades after vat 2

The new Archbishop of Cardiff has appointed a Private Secretary Fr Laurence Bryce (ordained 3 years ago). Fr Bryce will not only be a desk priest, but also have the oversight of a parish community and celebrate Masses on weekends. The Archbishop is now recruiting a Secretary and a part-time Housekeeper.

Pat, the smell of compo can lead to all kinds of allegations against people no longer around to defend themselves. It just take one substantial ‘settlement’ and lo and behold the ‘me too’ crew are lining up with one tale more horrendous than the last. I would take such allegations with a grain of salt. People in the 60’s and 70’s remembering all of a sudden and all in sync – seems strange to me. Human nature being what it is, compensation is a powerful motivation. Just ask any insurance company about fraudulent claims and you’ll quickly learn the legths of fantasy people will turn to to substantiate their fraudulent claims. Why would abuse claims be the exception?
We all know that abuse happened, and sadly still does – The majority within families. Did it happen in the church? Beyone a shadow of a doubt it happened, and all too frequently. But we must be careful, when money enters the equation the motivation for fraud is magnified a thousandfold.
I know this will draw fire from the hate brigade – but that’s the price of telling it like it is.

Bishop Pat sometimes your one liners are short and sweet but you will not want to say anything good about any Bishop.
However you know Bishop Fintan offered counciling and also a retreat and stupidly Coffey refused but that has been noticed and I do not think in a few years you will see Coffey in a diocese of Ireland he has blew that.

4.51 the allegations made by these 2 ladies were not false and yet some considerable time later no guarantee or information has been provided by Killaloe Diocese to deny or confirm that Fr Fitzgerald is not being facilitated to repeat more of the same in some capacity under his Roman Catholic Church umbrella. The RCC has a lengthy track record in aiding and abetting wrong doing even after credible complaints have been recorded. Killaloe appears to be a very strange and curious Diocese and attracts some very slippery characters and their Bishop is acting like a giant eel in these matters.

4.37: Frank, I support every word you have written. So true: when money enters the equation, all kinds of allegations can be created. This chasing after compensation does a grave damage and injustice to genuine survivors.

I think what Fitzgerald did to Yvonne and Karen was despicable. He should be dumped from the priesthood forever. I do not know Karen. But I did know Yvonne. Yvonne has been a vulnerable lady for a long time. Ger has compounded Yvonne’s vulnerability. He is the lowest of the low.

Good to see that the Bishop of Hexham and Newcastle has recalled Fr Tony Currer from his desk job in the Roman Curia. The only change made by Frank that I agree with is making Curia desk priests do shorter terms before going back to their dioceses to do the work they were actually ordained for.

Murphy is in the diplomatic corp, so those rules don’t apply. Miss will probably move on to be vice reactor at the VEC when his term is up, and an auxiliary bishop at 45.

Both Emlyn McGinn and Ryan McAleer were sexually abused as children by their family. Later in seminary both were sexually assaulted by seminary council. Emlyn enjoyed the abuse while Ryan screamed like a girl.

4. Cookstown – New subvariant of Just for Men hairdye called ‘Just for Father’ gets an outing. Somebody tell him it only needs 5 mins 😬
5. A cocktail of PPs dine in a Hotel in Cookstown each Saturday. Their conversations are boring mostly (the individuals are like the blue rinse brigade on tour) but have been overheard discussing private diocesan matters on this blog.
