The allegations are so preposterous and incredible that the Victorian police and justice system are under increasing scrutiny, especially in the wake of the Lawyer X scandal. The travesty of justice continues. You may not like Pell’s views but if this persecution succeeds all Christians will lose.

Why do you think Pell’s own Attorney said the following in court;
Richter tried to argue there were “no aggravating circumstances” to one of the offences. It was “no more than a plain vanilla sexual penetration case where the child is not actively participating,” he told the court.

The chief judge, Peter Kidd, responded: “It must be clear to you by now I’m struggling with that submission. Looking at your points here – so what?”

He said he saw Pell’s behaviour as “callous, brazen offending” and “shocking conduct”.

“He did have in his mind some sense of impunity. How else did he think he would get away with this? There was an element of force here … this is not anywhere near the lower end of offending.”

If I’ve understood your comment, Pell’s lawyer, Richter, actually admitted, in court, that Pell had indeed committed those offences against his accusers, but that they were so trivial that they didn’t warrant a prison sentence?

Context is important, indeed essential. Richter called “vanilla” the allegations as they were detailed. Since the plea he entered for Pell was not guilty he was hardly accepting that they had actually occurred! He was saying that the allegations as made were of a certain type and should be dealt with in a the appropriate way.
Since the jury returned a guilty verdict (to the evident shock of the judge as seen by those in court at the time) the judge was obliged to pronounce judgment on the basis that the crimes had occurred as alleged. So his language reflects that.
A British academic, Dr Chris Friels, has written many papers which shred the allegations against Pell, showing them to be physically impossible, as well as highlighting serious problems with the police investigation. Victoria Police is historically a chronically corrupt police force, and recent scandals make clear little has changed.
Fr Frank Brennan SJ, a liberal Catholic with strong social justice activity, and who had clashed in the past with Pell, has written a book detailing how the case against Pell was a travesty of justice. Fr Brennan is a fully trained lawyer, and the son of a former Chief Justice of the High Court of Australia.
That an allegation is made does not mean it is true. We may not like Pell, and many here do not like the Catholic Church, but false allegations must be exposed, if only for the sake of those who truly have been abused. Injustice endangers justice for them.

You missed the proverbial elephant in the room here.
I believe Richter’s arguing that the alleged offences against Pell were not serious enough to be tried in a court of law was an attempt by him, even at this late stage, to have the matter dealt with less formally, and, therefore, to have his client punished less severely should he be found guilty. This was revealing: a kind of Freudian slip by Richter that he suspected Pell might, indeed, be guilty after all, and so he was trying, as presumably would any good defence lawyer, to have his client punished more leniently than would a prison sentence.
Chris Friel did not demonstrate that the allegations were physically impossible, but he did demonstrate his forensic inability to think more thoroughly on these matters. There are more persuasive counter-arguments for Friel’s opinions.
Whether or not Victoria Police are ‘historically and chronically corrupt’ is completely irrelevant to this case, and it is a non-sequitur to imply that police corruption unfavourably compromised the Pell trial; you could not have any credible evidence to the contrary, since none was produced in any of the three courts that handled Pell’s case.
As for Frank Brennan SJ, telling us that he is a ‘liberal Catholic’, that he ‘clashed with Pell’, that he is a ‘trained lawyer’, and that he has solid legal pedigee since his father was ‘a former Chief Justice of the High Court’ may be interesting biography, but it is, again, completely irrelevant, since it does not, one way or the other, affect the reliability of his book on the Pell trial.

‘Richter said he was in a difficult position because he could only propose a sentence based on the jury’s finding of guilt, not on the basis that Pell maintained his innocence. He said Pell did not have a pattern of offending and had not planned the attack, and so would have been “seized by some irresistible impulse”.’

In fact the minority opinion at the first appeal demonstrated the impossibility of Pell’s guilt (in a brief of 200 pages or so, showing up the shoddiness of the two other judges’ reports), which is why the guilty verdict was unanimously overturned by the higher court.

This part of Pell’s trial is written about extensively in the press. I interpret this statement by Richer as, Pell is guilty, but ,it’s so inconsequential, it hardly adds up to a criminal offence, and if there is a jail sentence because of the “innocuous” occurrence, it should be lenient.
Richer is an eminent Australian barrister who has handled a number of high-profile cases including defendants unpopular in public opinion, so no fool.
He is an adjunct professor at Victoria University.
He is a critic of human rights violations and advocates for the rule of law.
Presumably that is the reason Pell selected a different Q.C. Sydney barrister Bret Walker for to run his appeal, although Richer lodged it.
Richer apologised for his use of words regarding the vanilla incident, but he did not withdraw his comment.

The first sentence of this quotation affirms my opinion of Richter, which was expressed in my post at 2.41: that he at least suspected Pell was guilty of the offences, and, therefore, sought to have the judge direct that the matter be handled not in a court of law, but less formally, so that Pell might not receive a prison sentence if convicted. Why else would Richter have stated that he, upon a guilty verdict for Pell, could suggest a sentence for his client based only on the jury’s finding rather than on any continued declaration of innocence by Pell himself? In such an event, Richter would have demonstrated, both to the court and to the watching world, that he had never, really, believed in his client’s innocence.
As for Pell’s allegedly having no pattern of such offending, there certainly were no criminal convictions against him, but there WERE other such allegations, including one from an indoor pool attendant who said that he caught Pell as he exposed his genitals to young boys in a changing area and warned him, after the boys had been sent home, that the police would be called if ever he returned.
The minority opinon in the Court of Appeal demonstrated that the allegations were false to no one but himself: both his colleagues were persuaded otherwise, and the Court upheld the conviction. Your inference here is biased and misleading.
You have demonstated, by your comment, not rigourous, incisive intellectual analysis, but a clear prejudice in favour of George Pell. I can see only one reason for this: that George Pell is a Roman Catholic priest, and a high-ranking prelate within the Roman Catholic Church.

How will Pell suffer? He is guilty of neglecting to shop Little and Mulkearns the moment he gained metropolitan power in 1996 – the ultimate power any Roman prelate can dream of. The Victorian detective Denis Ryan suffered for 50 years due to his employers’ collusion, with Pell not standing up for him. The whole Victorian public suffered for longer than that. This good and bereaved man has now had his family dragged into yet another convoluted scheme, which together with the obviously doomed financial posting was Pell’s agreed penance. Christians will be less at risk than they have been for a long time – provided the court doesn’t throw one of the usual Victorian kind of stupid stunts.

I was wondering when the Birmingham 6 would come up. You mean that case where racist police arrested six Irishmen they didn’t like the look of, for an offence the IRA had uncharacteristically not claimed credit for, and manipulated the evidence? The case that it’s unlikely ever will be prosecuted because the evidence was so extensively tampered with?

Before and after the court proceedings, many journalists and TV outlets had serious misgivings and concerns about this case, not from any Catholic church perspective but from the entirety of this case. It was flawed from the beginning. Cardinal Pell was targeted by abuse survivor groups and nasty, aggressive secularists. It remains to be seen but as you say, the travesty of justice continues.

This does rather sound as if the Victorian justice system, smarting from its humiliation some years ago over Pell, is determined to make him pay. So, it looks as though he will have to take the pain, and probably pay out some money in a civil case in the next few years. He will see it as part of the suffering cross that he has to bear, and will be able to spiritualise it to his own satisfaction and advantage. Such is the odd thinking of Catholics like Pell. All that ‘offering it up’ nonsense. He won’t go back to prison, and although he and the Melbourne Archdiocese may end up a bit poorer, he will be able to continue his comfortable life until he goes on to his eternal reward. If there is such a thing. However, there will always be a whiff of something rotten about Pell. That will be his legacy in this world.

Yes ! Why do you think the father is suing him in the civil courts ? It is about revenge. The father is pissed off that Pell did not stay in prison. He is pissed off that his son is dead. He wants everybody to believe that it is all Pell’s fault, although I am sure there are other contributing factors to the father’s and the son’s respective situations. Then, the Victorian courts will want to be avenged for their humiliation in the Supreme Court of Australia. Revenge is a powerful motivator, and Pell is going to have to put up with it. That’s life !

The faithful flatly refused to see that an unsafe conviction had been overturned on a technicality and that was the objective fact. They were crowing that this meant he was innocent, ignoring the sheer weight of evidence you would need even to get this into court.
A reminder that leaders of a cult are always right, always innocent, and their followers deem them persecuted.

No one should comment without reading Weinberg’s 200 page judgment which secured Pell’s acquittal. It was not about ‘a technicality’ but was a terrific x-ray of a travesty of justice, and a warning of the consequences if we twist the law to suit our bias, as happened with the B’ham 6.

The Pell case illustrates the pendulum nature of history. From a time where the Catholic church was untouchable to a time where anything and everything can be claimed against them. Incredible to think that the Pell case made it all the way to the top courts in Australia when it should have been thrown out on Day 1 . Shows that courts dispense justice according to the norms of the day rather than real justice of evidence and innocent till proved guilty . I see two women in America are now claiming that former boxer George Foreman abused them 40 years ago. It’s becoming an ATM machine for lawyers .

If you think the Catholic Church is being generous here, think again. It is getting its properties rennovated/refurbished FOR FREE by a cash-strapped state that cannot afford to build accomodation for refugees, so it asked the Catholic Church for help. How did it respond? With the generosity one might reasonably expect from an institution that claims Jesus as its founder? Like hell it did!

The Catholic Church is receiving a huge investment from the State AND it will receive as well rental payments from refugees that come directly from the State.

Anyhow, read the article linked at 12.12. It’s by two Australian academic lawyers, and it makes a bold, compelling case for the claim that Pell’s conviction was overturned on a legal technicality, not on a re-evaluation of the evidence against Pell.
Now I know you’re a Pellite and that it will be painful for you to read this article with an open mind, but sure, offer the pain for the souls in Purgatory.

Getting back to Pell, I took a considerable interest in his trial and his appeals. He’s not my kind of churchman. His way of dealing with abuse victims was not kind but designed to minimise the cost whilst presenting the institution in a good light.
I was never convinced beyond reasonable doubt (the criminal test) that he was guilty of the offences for which he was initially convicted and having read both appeal judgements, I am more convinced his ultimate acquittal was correct. However, when I watched documentaries which discussed his behaviour with boys in his younger days, around swimming lakes, I was more inclined to believe, at the *very* least, Pell had engaged in unwise and inappropriate behaviour. These issues were never, however, tested in court.
Even with the much lower bar for civil proceedings, this will go nowhere. Whether I have any sympathy for Pell or not, I do worry for the father of the late alleged victim who died before his time and in very tragic circumstances. I hope that he gains some closure through doing this but sadly I fear that he may only be hurt even more than he has been already. He is the one for whom I will pray in particular, in the hope that he finds some peace.

@6.46pm this story got complicated because there were two strands, obviously from two different sources. It started as something about a gay group holding orgies in Laois or Kildare. Nothing much in that. No law broken. Consenting adults and all that. Then someone was mischievous and added the Satanic/Black Mass dimension and threw in a few characters from the blog for good measure, Rawhide, etc. It had the desired effect of raising a lot of people’s blood pressure! Then there is another strand, which I am not familiar with, of someone from the diocese of K&L being in touch with Pat about the orgies and a priest attending.
Pat acted in good faith in making this public and was unaware that the Satanic aspect was false and that Rawhide was not present. To the best of my knowledge no priests attend this group but Pat may know more. Why he should be apologising to Dinny Nutty, I don’t know. Dinny doesn’t police the private lives of citizens in the county of Kildare or Queen’s County. Move on now, nothing to see here!

If something terrible happened in the woods, that is very sad and awful. I find it difficult to believe, however, that the guys I know who organise the house group, have anything to do with this.
