REPORTING JP LYTTLE’S SOLICITORS TO THE SOLICITORS REGULATION AUTHORITY.

Yesterday, I forwarded a formal complaint against Hill Dickinson and the solicitor who wrote to me with the English Solicitors Regulation Authority and provided them with the relevant evidence, etc.

This guidance is to help you understand your obligations and how to comply with them. We will have regard to it when exercising our regulatory functions.

Who is this guidance for?

All firms and individuals we regulate who conduct litigation and who give dispute resolution and pre-action advice.

Purpose of this guidance

To help you understand the application of our Principles and Codes of Conduct to these activities. As well as to highlight the different duties that you may owe to the court, to clients and to third parties (such as witnesses and opponents) in litigation. We describe situations in which these duties are not properly balanced to help illustrate how these can arise in practice and the serious consequences that can follow.

There will be situations where maintaining the correct balance between these different duties is not a simple exercise. This guidance is designed to help you identify the right course of action in such situations.

Features of these cases may include:

We are aware of concerns surrounding Strategic Lawsuits against Public Participation (SLAPP). This is a term commonly used to describe the misuse of the legal system, and the bringing or threatening of proceedings, in order to discourage public criticism or action. For example, cases in which the underlying intention is to stifle the reporting or the investigation of serious concerns of corruption or money laundering by using improper and abusive litigation tactics.

Features of these cases may include

  • making excessive or meritless claims, aggressive and intimidating threats
  • otherwise acting in a way which fails to meet the wider public interest principles
  • duties to which solicitors must have regard, and which are highlighted in this guidance.  

To help ensure compliance, you should always be vigilant in scrutinising your own and others’ conduct in disputes you are involved in. The behaviours described this guidance can be evidence of misconduct capable of amounting to a serious breach of our regulatory arrangements, and can inform your duty to report. This will help us to consider whether a serious breach of our regulatory arrangements has occurred. Read see our guidance on reporting and notification obligations.

Our Principles

Our Principles state that solicitors should always act:

Principle 1: in a way that upholds the constitutional principle of the rule of law and the proper administration of justice

Principle 2: in a way that upholds public trust and confidence in the solicitors’ profession and in legal services provided by authorised persons

Principle 3: with independence

Principle 4: with honesty

Principle 5: with integrity

Principle 7: in the best interests of each client

Should the Principles come into conflict, those which safeguard the wider public interest take precedence over an individual client’s interests. These include the rule of law and public confidence in a trustworthy solicitors’ profession and a safe and effective market for regulated legal services.

You should, where relevant, inform your client of the circumstances in which your duty to the court and other professional obligations will outweigh your duty to them. For example, you must not allow a client to knowingly mislead the court in order to further their case.

Independence (Principle 3) clearly includes independence from the client. This has also been explained by the Solicitors Disciplinary Tribunal (SDT):

A Solicitor is independent of his client and having regard to his wider responsibilities and the need to maintain the profession’s reputation, [they] must and should on occasion be prepared to say to [their] client ‘What you seek to do may be legbut I am not prepared to help you to do it” (In the matter of Paul Francis Simms, SDT, 2002).

This very much included medics and lawyers – and even the clergy.

But as time has gone on, modern democratic processes and the increased emphasis on human rights means we can now challenge our former unchallengable masters.

I’m pleased there is a Solicitors Regulation Authority.

I’m also pleased they are investigating SLAPP – that strategy used by unscrupulous lawyers, not to get justice for their clients, but to scare people away from making wrongdoing and corruption public.

SLAPP is the use of legal procedures – letters, summons, etc to scare people away from telling the truth about your client or putting the truth in the public domain.

It is an unprincipled and disgraceful strategy condemned by the SRA and all good lawyers.

Can anyone on here recommend a good religious trauma recovery therapist in the Munster area of Ireland or would one have to travel to Northern Ireland or the UK for an impartial consultation?

You could contact darraghfinlay.ie I don’t know him personally, but the RTT method he uses is excellent for trauma. If this way of working doesn’t feel right for the person, contact Darragh anyway, as he is connected in to practitioners across Ireland who are supporting people to work through trauma, stress and anxiety. Any good practitioner will be willing to have an informal conversation and answer frequently asked questions free of charge and with no obligation. Anyone who won’t isn’t (good). You could also consider online practitioners if the person has internet access and is in a home situation where they can speak privately. I do hope you can find the right support.

The Irish High Court in Carrigaline Community Television Broadcasting Co Ltd v Minister for Transport decided that both private citizens and the media are constitutionally protected in expressing their own opinions and the opinions of others.

But what is the jump from media to blog in a legal sense? Media implies journalist, editorial oversight and in house legal guidance. With due respect to +Pat he is a journalist of reputation but risks not being legally classified as “media” when blogging. Perhaps precedent already exists that answers my genuine question.
I am sure +Pat will have the evidence to defend against defamation. Essentially the other question is can GDPR rights be overruled in the name of Detraction? Or even to publish about a person’s sex life? A court might not see breach of chastity as worthy of publication because the legal system ost likely won’t recognise such promises/vows as any way binding.

This is a very interesting and thoughtful blog with very insightful comments and insights into religious corruption all over and its good that the Roman Catholic Church are finally being exposed and challenged for all the evil they are continuing to inflict on vulnerable women and children and just about anyone daft enough to engage with them.
It is abusive of clergy who are not adhering to the rules of their office to persistent in fundraising for a wealthy church with endless resources as the Vatican has. It’s brazen and blatant crookery.

I didn’t understand various terms such as ‘power bottom, bareback’. I was chatting with a guy who is gay re these words. He said its quite common in pornography movie industry re if you look or search for it.
Now I understood that some of you have been browsing or looking at pornography movies in the past or still do, and saw these words & used it on this blog🤣🤣.
He also said top or bottom questions usually asked inside the gay scene and also bdsm (not sure if it’s correct cos never heard of it until just recently cos it’s extreme etc. There was lot of gay/lesbian terminology that straight people don’t know or never heard of it.

Also suggestion re bitchy queen’s as I think you are right on that. Cos they gossip a LOT especially foul language, jealously, attention seeker/s (phonsie for example from my perspective) and might be dangerous as well. A gay friend that I fell out with in the past, was telling me that he was caught up in a perilous dangerous situation in London with a gay man for one night stand.

As the Roman Catholic Church is primarily populated by gay clergy and their close personal friends in paid and voluntary roles, they are probably one of the best places to familiarise oneself with sex industry terminology and rent boy speak etc.
Officially the Roman Catholic religion claims it’s clergy are celibate so a significant proportion of their activity is underground because as we have seen they are frequently compromised and blackmailed by substance addicted rentboys and the like when they socialise in those desperate circles.

homosexuals and therefore the vast majority of priests literally have their own world and terms used in it. Bottom is a taker, top a giver. Power bottom is a bottom that dominates the penis rather than the other way around. Fag hag is a woman that likes to hang out with gay men a lot.

I have no issue with gays but some of the men are a royal pain in the arse. They are very prone to shafting others at work and can be very bitchy. Some of them really don’t care if you’re gay or straight, they’ll chance you anyway. I had a guy once tell me he wanted to suck me off. I told him I was straight. He said no problem, close my eyes and pretend he was a woman doing it. Dirty feckers.

Yes I’m aware of fag Hag term cos I used to see many woman hang out with priest. Someone called them ‘fag Hag’ including our ex president whom herbrother’s name, I have heard it and bandied around in 1st school that I went to. He was a decade or lot more older than me (I think, not know his age). I never met him but came across his name with reference to his sister now chancellor of trinity college. She has 2 sons who are gays in addition to her deaf brother as well. That’s a big burden to carry isn’t or not? 🤷‍♀️.

Have no issue with gays cos I saw 4 or 5 deaf boys aged 5 or 6 acting like women as I was quite puzzled. It was only in late teenage years, all of them(5or 6) turned out as gays accurately that I realised the extent of their far young behaviour (its a pointer to future sexuality).

Did come across 2 deaf gays who wanted me as I told them that it might require the use of my fist. They were so brazen and cocky of their approach which I couldn’t believe my eyes. They didn’t give a damn. Then one day I met a taxi driver who quit as he told me that gay people have high sex drive than straights cos he was approached numerous times as a taxi driver. He’s a married man with kids but then he left taxi very quick, last time I saw him was working as bricklayer.

No problem DG. it’s not a world I know much about but have met plenty of them. It’s difficult and unfair to generalise but with a lot of them there is an anger and distrust underneath for straight people – all their lives they may feel they are looked on as different and the object of mistreatment/ridicule. I think that is changing a bit, but the older guard are certainly quite hostile. They tell the boss stuff at workplaces very quickly and would rat you out in 2 seconds. They are kind of a tribe of their own really. Lesbians I find are much easier to deal with; they may start off as angry/hostile but will become friendly after a while if they understand that you are genuinely liberal. Gay men not so. They have the worst excesses of female bitchiness. The TV show ‘Queer as Folk’ was a real eye opener for me at a young age.
As for promiscuity it is certainly an issue. TBH I have been propositioned more times directly by gay men than women (except in the US, where women will go straight for the goals, so to speak). What annoys me about it is not the attention – it is mildly flattering – but the fact that some of them simply don’t care if you are straight. I went out one night in Canal Street in Manchester on work do with a load of women and was pestered by several gays who had major difficulty accepting I wasn’t interested and literally out for a few pints. They try to say things to you like ”It’s ok, don’t be nervous” and such like while groping your arse. It’s appalling predatory behaviour that is not tolerated on women anymore but is a nightmare with gay men.

To be honest with ya, I haven’t been searching for a trauma therapist cos I have been looking for a surgeon for some time.
Been to world class surgeon last year as they treated lot of Premier league or professional soccer players over the years. They gave me a direction in another area. Which I had to start it all over again fresh. Hence my search for another surgeon was taking my time instead of trauma therapist.
Do u know any trauma therapist out there as I decided not to use toward healing at all. Ex therapist left completely leaving all his ex client in a bit of quandary.
So far it’s good except for hyperviligance as i trust myself to deal with it. Thank god I was able to deal with most issues now than I was in some 6 or 7 years ago. Lot of work on myself finding what’s triggered that trauma thing as it’s coming to the surface slowly. It just take time. Still I want to see a trauma therapist provided the distance is not too far etc.

The grotesque impertinence of such men, telling generations of 7-year-olds that they are sinners in need of confession before receiving First Holy Communion or any Communion thereafter. I agree @ 8.27. My local weekly paper: I’ve stopped getting it. It’s usually 70/80 pages, often a third of which is photos of smiling priests or occasionally a bishop with rows of ‘first communion or confirmation pupils.’ The RCC educational system in Ireland is virtually a totalitarian propaganda machine starting children in a lifetime of guilt.

The RCC say that they respect the dignity of human life from the moment of conception to the last dying breath. This is a damn right out lie .what dignity was given to the abused children under their care and the cover up superiors who should have known better. A big day of questioning will come .

They think they’ll succeed were others (who are much more capable) could not.
They lack self awareness. They think we are all players in their game. They may never learn that that is not the case. I’m not sure they’re capable of ever learning that they are not the centre of the universe!
However, Harry is attending the Coronation, Megan has been dropped. This will soon be the situation with the Harry and Megan of Portsmouth. The divorce is inevitable. Everyone can see it it seems accept Harry and Megan themselves! Hopefully it won’t be a long, drawn-out, humiliating divorce. Let’s hope it is as quick as is possible!

All authority bodies and agencies of any kind are now subject to questioning. Many legal entities have been found wanting re: their transparency, integrity and judgments. Many solicitors and medics have been struck off for their unprofessional conduct and behaviour, for their complicity in negligent practices causing material and medical harm to clients. The various law and medical fitness to practice investigations are very thorough but don’t always side with the complainant. The outcomes are very unsatisfactory. However, despite the public ignominy of any person who feels aggrieved by narratives, isn’t that person still entitled to some protection from ongoing harassment and deliberately denigration of his/her character? HAVING CLEAN HANDS going to any court is a principle worth keeping in mind…Does JPL have clean hands in arguing his defense? What constitutes clean hands? When can a complainant defend his mental, emotional and personal well being against the continuum of personalised attacks? Just curious…

Well done Pat, all that’s being achieved by that solicitor’s letter, is to pour more attention on Lyttle, the opposite to what was hoped to result.
Solicitors are only too happy to use a template letter, fill in a few changes, exorbitant charges, easy money made, with absolutely no effect, and in this case aggravating the situation.
Similar to the Roman Catholic church, the law society cannot be trusted. Note, the Solicitors Regulation Authority (SRA) is regulated by itself. Enough said!

The Law Society used to regulate itself. The SRA was established as an independent body to prevent the old boys from judging themselves in smoke-filled rooms behind opaque glass. The Legal Services Board (LSB) has oversight for the SRA.

There are at least two things in the modern world that make it easier to reveal more of what’s going on behind the ecclesiastical curtain:
1. The sheer volume of online intelligence including diocesan accounts helps with the investigative exhortation to ‘follow the money’. This also provides potential links between individuals and institutions who would otherwise prefer to be anonymous. These resources need systematic and continuous assessment.
2. The phenomenon of ‘hiding in plain sight’ has become all too familiar in the last decade with the exposure of criminal behaviour of so-called ‘celebrities’ such as Saville, Hall and Harris. They were aided in their criminal behaviour by their media mystique in elevated roles and the normalisation of their practices in a different age. There are people still hiding in plain sight in parishes, monasteries, seminaries and schools but we now have the advantage of better awareness and the disinfectant of continuous attention and publicity. This better awareness of abnormal behaviour needs to be deployed ruthlessly and lawfully.

He’s gonna get his fat little arse kicked – he picked the wrong fight, the wrong client and the wrong legal issue (GDPR violation).
Diocesan lawyers both retained and outsourced are greedy bastards and I’ve seen the clergy go all weak at the knees around them – Elsie and Nursey big time only to realise that for the lawyer it’s all about running the clock and the big fat pay check!!

Very interesting. Significant that the Director of Communications post is vacant. Had there been someone in place they probably would have advised JPL not to do his futile recourse to a solicitor. An experienced comms person would know that there is nothing to be gained in trying to tackle Bishop Buckley that way, and that it was bound to backfire.

So sorry to disappoint but Heather is going nowhere fast. She believes being the Chief operating officer is her vication and God Wills for her to be leading the Diocese. The clergy will have to get used to the new ways of doing things or transfer to another diocese. The sooner the better.
